신용장통일규칙(UCP 600)에서 해상운송서류 조항에 대한 고찰

세계 상품무역의 80% 이상은 해상운송에 의하고 있다. 해상운송에는 선하증권, 해상화물운송장 등의 해상운송서류가 발행되는데, 통상 이러한 운송서류의 제공은 수익자(수출자)의 주된 의무가 된다. 신용장이란, 신용장조건과 일치하는 서류가 제시되면, 수익자 앞으로 대금을 지급하는 약정이다. 따라서 신용장방식에 의한 무역거래에서는 지급청구의 요건으로 운송서류의 제시가 요구되고, 개설은행은 신용장조건과 ‘일치하는 제시(complyingpresentation)’에 대하여 지급의무가 있다. 따라서 운송서류는 신용장방식의 무역거래에서더욱 중요한 의미를 가진다. 신용장조건과 ‘일치하는 제시’는 기본적으로 해당 신용장, 신용장통일규칙(UCP 60), 그리고 국제표준은행관행(international standard banking practice)에 의하여 판단되며, 운송서류의 조건도 동일하다. 따라서 해상운송을 수반하는 무역거래에서는 해상운송서류에 대한 신용장통일규칙의 조항을 이해하는 것이 요구된다. 현행 신용장통일규칙(UCP 60)의39개 조문 중에서 해상운송인과 관련된 주요 조항은 제20조(선하증권), 제21조(비유통해상화물운송장), 제26조(갑판적재, 내용물 부지약관), 제27조(무고장 운송서류) 등이다.
Abstract
More than 80 percent of the international trades in gods are performed by maritmetransport. In maritme transport, maritme transport documents such as bil of lading andsea waybil are isued. A credit (or a leter of credit) means an arangement to pay toa beneficiary if a complying presentation of documents is made. Thus, in an internationaltrade with a credit (or a leter of credit), transport documents are required for thepayment by an isuing bank, and an isuing bank must honour (or pay) a complyingpresentation. In this context, transport documents have very signifcant implications foran international trade by a leter of credit. Complying presentation shal be basicaly determined by the terms and conditons ofthe credit, UCP 60, and international standard banking practice. In this respect, it isnecesary to understand the maritme transport documents provisions under the UCP60. The relevant provisions on the maritme transport documents are Article (Bil ofLading), Article 21(Non-Negotiable Sea Waybil), Article 2 (Charter Party Bil of Lading),Article 26 ("On Deck", "Shiper's Load and Count", “Said by Shiper to Contain” andCharges Aditonal to Freight), and Article 27 (Clean Transport Document
