VoluntaryGuidelines on Responsible Governance of Tenure of Land, Fisheries, and Forests(VGGT)라는 국제 가이드라인이 채택되었다. UN-REDD(Reducing Emisions from Deforestationand forest Degradation)에서 land tenure를 보유한 현지 주민에게 산림탄소거래의 수익을분배하려는 시도가 기후변화 논의에서 최근 이슈화되고 있다.

Abstract

In 2012, the Voluntary Guidance on Responsible Governance of Land, Fisheries, andForests(VGGT) was adopted to protect the land tenure of local residents in variousdevelopment projects. In the UN-REDD(Reducing Emisions from Deforestation andForest Degradation), an atempt to share the profits of forest carbon transactions withlocal residents holding land tenure has recently emerged as an important isue in climatechange discusion. The labor-sharing asociation, which exists in forestry vilagescolecting fine-mushroms in Korea, is not initated by a foreign aid organization, butwas formed voluntarily by local residents to preserve the forest, the habitat of pinemushroms. Local residents set their own rules to plant and care for tres in the mountains nearthe vilage, to secure forest resources esential for harvesting pine mushroms. Vilagerswho do not participate in the labor-sharing asociation are not permited to harvest pinemushroms, so they developed these norms on their own before any state powerintervened. Forest carbon projects ned to invest enormous expenses to secure forest carbon credits. If a vilage operating sustainable forest management, such as a pinemushroms harvest vilage, participates in the forest carbon ofset project, aditonalprofits can be expected through the transaction of forest carbon while maintaining in thecurent state. However, there is no previous study on administrative procedures of whether localresidents colecting pine mushroms have the right to the profits of carbon transactions. In other words, there is no existing research on how to check land tenure owned by localresidents and guarante the right. Therefore, in order to secure the legitmacy of theforestry carbon project that imposes restrictions on ownership right, this study proposeda feasible alternative granting carbon rights to the labor-sharing asociations in mountainvilages harvesting pine mushroms. The result of this study wil help overcome thecurent legal instabilty that does not grant carbon rights for local residents facing theforest carbon busines, thereby securing the basis for carbon transactions mutualybeneficial to both the forestry land owner and local residents. This study is signifcant in that it ofered procedural legitmacy to cary out carbontransactions at mountain vilages by granting carbon property rights to local residentsocupying forest carbon in Korea
