산불피해지 복구제도 개선을 통한 산림 탄소흡수원 강화에 관한 연구

기후변화에 대응하기 위하여 산림 탄소흡수원을 유지하고 증진하는 것은 매우 중요한 문제이다. 우리나라 또한 2050 탄소중립 시나리오에 따라 산림 탄소흡수량을 증진시키기 위한 탄소흡수원 증진계획을 수립하여 실행하고 있다. 본 연구에서는 산불피해지 복구와 관련이 있는 탄소흡수원법, 산림자원법, 산림보호법을 분석하여 이들 법령에서 나타나는 문제점과 이에 대한 보완ㆍ개선 방안을 제안하였다. 그 방법으로 첫 번째, 산불피해지 복구에 있어서 현재 시행되고 있는 탄소흡수상쇄사업을활용한 민간 참여를 활성화할 수 있도록 관계 법령을 보완하고, 두 번째, 파편화되어 있는 우리나라사유림의 소유 구조를 고려하여 산불피해지 복구의 책임 주체를 피해지 규모와 지역에 따라 명확히구분한다, 마지막으로, 산불피해지 복구에 있어서 산림탄소센터를 통한 산림탄소상쇄사업 활용의제도화를 제안하였다.
Abstract
Maintaining and promoting forest carbon sinks in response to climate change is a very important issue. Korea has also established a plan to increase forest carbon uptake under the 2050 Carbon Neutrality Scenarios. The acts related to the current reforestation of forest fire damaged areas, the ‘Act on the Management and Improvement of Carbon Sink’, the ‘Forest Protection Act’, and the ‘Creation and Management of Forest Resources Act’ were analyzed in this study. As a result, problems of the current restoration of forest damage areas and potential improvements were proposed. First, supplementations of the laws and regulations are needed to induce private participation on the carbon offset project currently in effect. Second, in consideration of the fragmentary ownership of private forests, responsibilities for reforestation of forest fire damaged areas should be clearly classified by region and size. Finally, reforestation of forest fire damaged areas by utilizing the carbon offset project of the Forest Carbon Center and its institutionalization was proposed.
