본고에서는 행정법상 특허 개념이 주로 연혁에 초점을 맞추어 다루어진다. Otto Mayer의 특허 개념(Verleihung, Konzession)부터 시작해서, 그에게 영향을 미친 프랑스법의 특허 개념(concession), 우리에게 큰 영향을 미치고 있는 전통적인 독일법의 특허 개념(Konzession)을 순서대로 분석해서 서로 비교한 다음에, 이와 구별되어야 할 개념으로서 독일법의 공무수탁사인(Beliehene)과 특허 방식의 민관협력, 그중에서도 특히 공공서비스특허(Dienstleistungskonzession)를 검토한다. 이러한 비교법적 연구가 우리의 행정법이론을 이해하는 데 도움이 되었으면 한다.
Abstract
This article deals with the concept of License under Administrative Law, focusing on his historic transition. Otto Mayer's definition( “Verleihung” or “Konzession”), the French law definition(“concession”) and the Deutsch traditional definition("Konzession) are analysed one after another and each other. Subsequently, “Beleihung” that is Delegation of Administrative Power to Private Parties, “Konzessionsmodell” that is one type of Public-Private-Partnership are discussed to be compared to License. Anyway, this study in the comparative method will be expected to be useful in understanding the Administrative Law Theories.
