한-페루 FTA는 중남미 국가들 중에서 칠레 다음으로 한국이 체결한 두 번째 FTA로서, 중남미 시장 개척을 위한 교두보 역할을 할 것으로 기대된다. 환경적 측면에서도 한-페루 FTA는 중요한 의미를 지닌다. 한국은 미국, EU와의 FTA에서 환경분야를 별개의 Chapter로 FTA에 포함시켰으나, 다소 수세적인 입장에서 환경을 FTA의 범위에 포함시킨 경우였다. 이에 반하여 한-페루 FTA에서는 개발도상국과의 FTA에서 환경분야를 독립챕터로 FTA에 포함시킨 첫 사례가 된다. 한-페루 FTA 환경챕터는 총 14개 조항, 1개의 부속서로 구성되어 있으며, 최근 발효된 한-미 FTA 환경챕터의 내용과 상당히 유사하다. 한-페루 FTA는 한-미 FTA와 마찬가지로 환경 보호 수준 설정, 환경법의 적용 및 집행, 무역 및 투자 촉진을 위한 환경법상 보호 완화 금지, 제도적 장치, 환경 협력 등을 규정하고 있다. 그러나 한-미 FTA 환경챕터와 비교하면, 한-페루 FTA 환경챕터는 대중 참여 및 절차적 보장, 환경 성과 향상을 위한 메커니즘, 엄격한 분쟁해결절차 등을 담고 있지 않다. 한-페루 FTA 환경챕터는 전체적으로 볼 때, 한-미 FTA 환경챕터 보다 완화된 내용을 규정하고 있다.
Abstract
Korea-Peru FTA, the second FTA that Korea has concluded with the South American countries, is expected to have positive impacts on Korean economy. Korea-Peru FTA may be regarded as pro-environmental FTA in a sense that it includes the separate environmental chapter. Environmental Chapter in Korea-Peru FTA consists of 14 provisions and one Annex. Environmental Chapter in Korea-Peru FTA is quite similar to the one in KORUS FTA. Both FTAs have provisions of the level of environmental protection, effective enforcement of environmental laws and regulations, institutional mechanism, and environmental cooperation. Korea-Peru FTA, however, does not require the Parties’ public participation in the implementation of the agreement. In addition, dispute settlement mechanism does not apply to the matters arising from environmental chapter. In that regard, Korea-Peru FTA’s environmental chapter is less restrictive than KORUS FTA.
