초록

현대 이슬람금융과 관련해 제기되어 온 핵심적 쟁점들을 이슬람금융의 ‘이슬람성’의 의미와 ‘대안성’의 의미를 둘러싸고 경합하는 담론적 지평을 통해 살펴본다. 이슬람성을 둘러싼 논쟁의 진영은 샤리아 규정의 법적 형식을 중시하는 ‘샤리아를 준수하는’ 접근방식과 샤리아 가치의 실현을 중시하는 마카시드 샤리아 접근방식으로 대별되며, 관행금융에 대한 대안성을 둘러싼 논쟁의 진영은 대체적 대안성을 추구하는 입장과 선택적 대안성을 추구하는 입장으로 대별된다. 이러한 틀 속에서, 이슬람금융에 대한 이론적 구상과 제도적 실천 사이에 발생하는 괴리와 모순을 평가하고, 현재 이슬람금융이 직면한 도전과 변화의 방향을 가늠해본다.

Abstract

This paper aims at evaluating key issues in contemporary Islamic finance from the perspective of competing meanings of the ‘Islamic alternative.’ Regarding how to define ‘Islamicity’ of Islamic finance, ‘shariah-compliant’ approach has been in contrast to ‘Maqasid Shariah’ approach. Regarding how to define the relations between Islamic finance and conventional finance, there have been differing views between substitutive alternative and optional alternative for the status of Islamic finance relative to conventional finance. With these discursive debates in mind, the paper evaluates the gaps and contradictions between theoretical constructions and institutional practices of Islamic finance.
