이슬람금융은 이슬람율법인 샤리아에 따라 이자수수가 금지되는 등 일정한 제한을 받고 있다. 보통 이슬람채권으로 불리는 수쿠크는 이러한 샤리아율법을 준수하면서 기업의 자금조달수단으로 이용되고 있다. 이러한 샤리아적격성을 갖춘 수쿠크는 전통적인 회사채 방식과는 일정 부분 차이가 있다. 지난 10여 년간 수쿠크의 발행은 급속도로 성장하고 있다. 하지만 그 중 일부는 채무불이행 상태에 처하기도 하였으며, 그 과정에서 투자자(채권자) 보호를 강화하고 이익 및 손실의 분담이라는 원칙에 충실하기 위해서 수쿠크의 구조에도 일부 변화가 가해지고 있다. 수쿠크의 경우 이자지급이라는 방식을 피하면서도 투자자들에게 투자이익을 돌려주기 위해 여러 방법들을 고안하여 사용하고 있는데, 이는 비이슬람권 국가들이 이슬람권의 풍부한 자금을 활용하기 위하여 수쿠크 제도를 도입할 경우 법제도의 차이와 과세 등의 문제와 관련하여 일부 문제를 발생시키는 원인이 되기도 한다. 영국 등 일부 국가는 일찍부터 관련 법제를 개정하여 적극적으로 대응하고 있다. 우리도 최근 몇 년 사이에 국내기업들의 수쿠크 발행을 허용하는 문제를 검토하고 있으며, 관련 세법 등을 개정하여 제도적 지원을 하려하고 있다. 하지만 법제도적, 문화적, 종교적 문제 등이 혼재되면서 논의의 진전이 이루어지지 않고 있다. 이슬람권의 투자자금을 유치하는 수단으로서의 수쿠크 제도를 검토하고 그 도입에 관한 문제점을 논의한다.
Abstract
According to islamic law, Shariah, there are some religious restrictions such as prohibitions on collection of interest and speculative investment, and so on. Shariah-compliant Sukuk, also called islamic bond which is different from conventional corporate bond, has been used a means of corporate debt financing. Last decade, sukuk issuing has rapidly grown and is fast becoming part of global capital market. But sukuk defaults have risen in global financial crisis, there is need to adjust sukuk structure to strengthen protection of creditors and to fulfill more effective shariah-compliance in such a situation. In sukuk, some innovations have yielded that are able to function like as conventional corporate bond without violating the prohibition of collecting interest. At the same time, however, these innovations raise some problems on the difference of legal system and tax aspects and others, when non-islamic countries introduce sukuk to use abundant islamic capital. Some countries such as U.K, have already responded positively through amendment the related laws. We also have reviewed the problem that allow domestic corporations to issue sukuk, and tried to provide institutional support with revising the tax law. But there hasn't been much progress due to legal, cultural, religious matters. I would like to review sukuk as a means of islamic capital and consider matters on its introduction.
