의학전문직업성과 자율규제 관점에서 살펴본 외국 의사면허 관리제도의 동향과 시사점

최근 일회용주사기 재사용으로 C형간염 집단감염이 잇따라 발생하면서 한국사회에 큰 충격을 주었 다. 이번 사건이 지금까지 발생한 사건과 달리 파장이 컸던 까닭은 도박이나 음주운전과 같은 개인의 사 적 영역에서 벌어진 도덕적 일탈행위가 아니라, 질병으로 인해 의사로서 진료행위 수행능력 상실, 보수 교육 대리출석, 무분별한 의료행위 위임 등의 정황이 알려지면서 면허관리제도의 허점이 드러났다는 데에 있다. 사건발생 직후 정부는 면허관리제도 개선안을 발표하고 이를 추진하고 있으나, 추진방향과 진행방식은 여전히 논란이 많은 상황이다. 이에 본 연구는 자율규제를 통해 의사로서 의학전문직업성 을 유지하고 발전시켜가고 있는 외국의 면허관리 동향을 살펴보고, 우리나라 현실에 적합한 대안을 모 색하고자 한다. 이를 위해 우리나라 의료제도에 많은 영향을 끼친 일본과 미국, 그리고 모범적인 면허관 리 사례로 자주 인용되는 영국과 캐나다를 중심으로 이들 국가의 의사 면허 취득과정과 면허유지를 위 한 조건, 면허관리기구의 특성과 운영현황을 살펴보았다. 외국의 경우도 의사의 의료행위에 문제가 발 생하였고, 이러한 문제의 해결방안으로 면허관리제도가 발전하였다. 외국의 면허관리 동향은 정부의 개입은 줄이면서 의사의 전문성에 의한 자율규제를 확대하는 추세이다. 이에 본 고에서는 우리나라도 장기적으로는 의사의 전문성에 의한 자율규제 방안을 추구하되, 관련 당사자들의 인식 변화와 제도마 련 등을 감안한 점진적 개선방안을 제안하였다.
Abstract
A series of recent medical scandals in South Korea has led to calls for stricter regulation of medical licensing in this country. While the Korean government has recently revised its regulations, disagreements remain among the various stakeholders. This article explores the regulatory systems in Japan, the USA, the UK, and Canada to identify the most appropriate principles for self-regulation based on medical professionalism. The Japanese Medical Association has been working to improve its certificate system for specialists since 2011. The USA, the UK, and Canada have independent regulatory bodies to protect patients and improve medical professionalism and practice. This article explains how the licensing system for Korean physicians should be regulated.
