프랑스 계획행정의 발달사에 관한 소고: 규제 및 보존적 계획제한을 중심으로

본 고찰은 일찍이 “계획 없으면 개발 없음”을 공간계획수립의 기본원칙으로 하고 있는 프랑스의 경우를 그 대상으로 했다. 프랑스 계획행정의 발달 및 전개는 계획 관련법제의 형성을 통해 잘 나타나는데, 보통 19C의 도시법, 세계대전기간 중의 도시법, 전후부흥기의 도시법, 고도성장기의 도시법 등 네 단계로 나누어 살펴볼 수 있다. 여기서는 경찰･규제적 도시계획과 보존적 도시계획을 주요 내용으로 하는 2단계까지만 고찰 대상으로 정한다. 오늘날 우리나라는 국토종합계획-지역계획-도시계획이라는 3단계적 국토공간계획체계를 유지하고 있는데, 중앙집권적 국가이면서도 중앙정부와 지방정부간의 적절한 조화와 역할분담이 잘 이루어지고 있는 프랑스의 경우는 우리의 권한이양 및 지방분권화사업추진 이후의 도시계획 및 지역계획의 수립권 내지 주체의 변화 등을 논함에 있어 여전히 주요한 논의의 대상이다. 이에 역사적 고찰로써 참고하고자 한다.
Abstract
This study was a research target early if there is "No development without planning"the basic principles of space planning, in the case of France. In France, development and deployment of the planning administration express well through the formation of the plan related legislations. Such as the law usually divided into four steps where of the city law of 19C, the city law of World War I･Ⅱ in period, the city law of the Renaissance and after World War, the city law of the high growth. Where is the main content of the police･regulatory and conservative urban planning were discussed until the two step in the urban planning history. Today, Korea are maintained National Comprehensive Plan - Regional Planning - Urban Planning for Land Space Planning a three phase system, while ever the centralized state in France, central and local government between appropriate balance and roles made well-being. In the case of France, which is the competence transfer and decentralization business promotion since urban planning and regional planning of the establishment rights or of the such subject's changes are still target the main of the discussion. Therefore, I would like to see as a historical study.
