우리나라 광역행정협력제도의 비교 고찰과 개선방안

본 논문은 현재 우리나라에서 시행되고 있는 광역행정협력체제의 역사적 변천을 검토해 보고 현재 각 제도의 장단점을 도출하여 그 개선방안을 제시해 보고자 하였다. 최근에는 광역자치단체별로 점점 쇠락해가는 지역의 발전과 경제적 역량을 회복하기 위해 광역지방자치단체 간 특별지방자치단체 설립을 통한 광역특별연합의 추진에 적극적인 모습을 보이고 있다. 그동안 자치단체조합이나 행정협의회 등 다양한 방법으로 지방행정 협력사업과 정책을 추진해 왔으나 그 실효성과 정책적 효과는 크지 않았다. 특히 지방자치단체조합의 경우 조례제정권, 인사권, 예산권 등의 법적 권한을 충분히 행사할 수 없고, 행정협의회의 경우 역시 강제적 이행력을 확보하지 못해 형식적 운영으로 한계를 나타냈다. 작년 국회를 통과한 지방자치법 개정으로 이제 광역특별연합의 구성을 통한 광역 공동사무처리가 법적으로 완성되었고, 앞으로 점차 지역의 대규모 숙원사업들이 광역자치단체간의 공동의 노력으로 큰 정책적 효과를 확보할 수 있을 것으로 예측된다. 이 특별지방자치단체는 국가 또는 시도위임사무를 모두 처리 할 수 있고, 입법고권 등 자율적인 행정법적 권한이 크게 보장되어 있어 업무상 정책집행권한이 크게 보장되어 있다. 그러나 이것 역시 다분히 주요한 대도시 위주의 지역 발전전략으로 농촌지역이나 지역 소도시 등이 소외되어 빈익빈, 부익부의 지역 발전 효과로 귀착될 수 있는 정책적 불균형의 외부효과에 대한 통제에도 제도적 보완이 필요할 것으로 생각된다.
Abstract
This research detects whether the regional administration system is going well till now or not with its historical transition posing the revised alternatives to improve the local autonomy effectiveness in Korea, Central government strongly intervenes in the local government’s cooperative system since 1970s. By the way, the effectiveness of central government’s intervention was not successive perfectly. There are some reasons why the regional administration system was not successive on a large grand. Fundamentally, this paper is focused on the special local agency which it is based on new revised local autonomy law in 2020. Now local agencies can establish the new regional special federation with each other between them to solve the regional problems and issues occurred across two and three local agencies. According to this analyzing, local special agency can solve the regional problems more effectively than before. Because local special agency can erect bylaw and budget and personnel rights without central government. In other words, local special agency can carry out its economic potential capability to improve the regional development. This means that regional local agencies want to make the mega-city to congregate their potential power between them to come true their economic goal. This analysis proves that the local special agency will take the chance to heal its economic ability more than previously in the near future. Consequently, regional special agency will have the higher efficiency to come true real local autonomy with the same level of advanced countries. Moreover, this bring balanced national development and distributive equity and so on.
