범죄 프로파일링제도 운영의 문제점과 발전방향 : 경찰 범죄분석요원 및 기존 수사관의 인식조사를 중심으로

국내에서 최근 몇 년간 불특정 다수를 대상으로 한 소위 ‘무동기 범죄’가 증가 양상을 보이면서 이러한 강력 연쇄범죄 사건의 수사와 조속한 해결에 많은 어려움을 겪어왔다. 과거보다 법과학(forensic science) 및 범죄 감식기술의 발달로 경찰의 수사 역량이 크게 나아지고 있음에도 불구하고 이러한 유형의 강력범죄는 범인의 근거지 및 용의자 특정을 위한 수사기관의 노력을 더욱 크게 요구하고 있다. 이런 배경에서 경찰청에서는 이런 문제 해결에 핵심적 역할을 맡아 줄 것이라는 기대와 함께 2005년 이후 심리학 등을 전공한 전문가를 범죄분석요원으로 특채하여 용의자 추정 및 수사에 한계가 많은 강력사건 해결을 위해 운영해왔다. 이에 이 연구에서는 그동안 경찰이 다소 선진화된 범죄분석제도와 시스템을 운영하면서 직면한 문제점들과 그에 대한 발전방향을 찾기 위해 수도권에서 근무하는 국내 범죄분석요원들과 기존의 일선 수사관들을 대상으로 면접조사를 중점적으로 실시하였다. 경찰청 과학수사센터와 외국 경찰 범죄분석 전문가에 대한 면접조사도 병행하여 전반적인 제도 운영의 한계와 장애, 이에 대한 극복방안을 탐색하였다. 조사 결과를 요약하면 한국형 범죄분석의 올바른 정착과 발전을 저해하는 주요 문제점으로는 범죄분석요원의 투입 시기의 지연 및 범죄정보의 누락, 한국적 범죄분석 연구지원 체계의 부족, 범죄분석요원의 수사 경험 부족, 범죄분석 전문교육의 부족, 불안정한 인사제도 운영 등으로 분석되었다. 이에 따른 해결방안으로는 범죄정보 중앙수집 의무화를 통한 범죄분석 개입 결정권의 이동, 행동과학 수사계 구성, 범죄분석 전문교육 담당부서 창설, 특채자들의 인사불안정 해소를 위한 인사제도 개선 등으로 요약되었다.

Abstract

More and more so-called motiveless crimes have been the recent features of the main obstacles and difficulties for police criminal investigation of serious criminal offences in Korea. Even though the gradual development of forensic science and technology are enhancing the capacity of criminal investigation, motiveless crime or serial offences with no obvious linkage with no doubt have become an embarrassing reality for the Korean police investigators and demand a lot more endeavors for identifying and specifying suspects. In this background, Korea National Police Agency (KNPA) began employing profiling experts from relevant academic field, such as criminal psychology and encouraged them to solve the unsolvable cold cases and hard-to-solve cases. This study hence explored the strengths and weaknesses of the new police profiling system by interviewing newly employed criminal profilers and career detectives so that proper countermeasures and solutions can be suggested. Overall, there were problems in the timing of new profilers' intervention for cases and the lack of criminal intelligence, the lack of profilers' experience, the poor system for police profiling-related research and study, unstable personnel management system. The provision of early intervention opportunity for profilers, the restructuring and organization of Behavioral Science Unit, the improvement of criminal profiling education & training system and profilers' personnel management were suggested for the solutions.
