국내외 범죄자 프로파일링 수사제도 비교연구

초록

본 연구는 변화된 수사환경에서 경찰 프로파일러들의 실질적인 역할에 부합하는 제도로 개선이 필요하다는 인식에서 시작됐다. 이에 따라 국내 프로파일링 제도 현황을 검토하고, 수사환경에 맞춰 프로파일링 분석 방법을 정립하고, 전문인력을 운영 중인 미국, 영국, 독일, 일본 경찰 제도를 비교하였다. 연구 결과, 국내 경찰에서는 프로파일링 제도 도입 초기 형태를 유지하며, 행동과학적인 수사지원이 필요한 모든 수사분야를 프로파일러의 활동 범위로 규정하고 있었다. 그러나 해외 국가들에서는 미국의 범죄수사분석(CIA), 영국의 행동적수사자문(BIA), 독일의 사건운용분석(OFA), 일본의 통계적 접근 등 프로파일링 수사 활용 내용과 범위를 구체화 시킨 차이가 있었다. 이러한 국가별 수사 활용 개념에 따라 독립된 조직 구성, 표준화된 업무 절차, 인력 선발 및 자격 검증 등이 체계적으로 이루어지고 있었다. 이러한 차이점들을 기반으로 국내 경찰에서도 현재 프로파일링의 수사 실무적 활용에 초점을 맞춰 직무의 개념과 수행 절차를 명확히 할 필요가 있다. 이후 독립된 조직 구성, 분야 별 세분화된 전문인력의 선발, 엄격한 자격관리 등을 우선적으로 추진할 필요가 있다. 이는 프로파일러들의 수사지원 활동 한계를 극복하고, 변화하는 수사환경에 적합한 효율적 제도운영에 도움이 될 것이다.

Abstract

This study was motivated by the need to improve the system to meet the actual role of police profilers in the changed investigative environment. Therefore, we reviewed the current status of the domestic profiling system, established a profiling analysis method in line with the investigative environment, and compared the police systems in the United States, the United Kingdom, Germany, and Japan that operate specialised personnel. As a result of the study, the domestic police maintained the initial form of the profiling system and defined the scope of profilers' activities as all investigative fields requiring behavioural science support. However, there were differences in the contents and scope of profiling investigations in overseas countries, such as criminal investigative analysis(CIA) in the United States, behavioural investigative advice(BIA) in the United Kingdom, operational case analysis(OFA) in Germany, and statistical approach in Japan. Based on each of these concepts, independent organisational structures, standardised work procedures, and personnel selection and qualification were systematically implemented. Based on these differences, it is necessary for domestic police forces to specify the concepts and procedures of their duties, focusing on the practical use of profiling in investigations. Then, it is necessary to prioritize the establishment of an independent organization, the selection of specialists divided by field, and strict qualification management. This will help to overcome the limitations of profilers' investigative support activities and to operate an efficient system suitable for the changing investigative environment.
