Abstract
This study evaluates a restorative policing(restorative dialogue) program piloted by the National Police Agency. A questionnaire survey (21 people) was conducted for the police officers in charge who participated in the program, and the process and effect evaluation was conducted. For the process evaluation, spontaneity of work, experience of restorative dialogue, perception of the adequacy of the number of incidents subject to restorative dialogue, recognition of the purpose of restorative dialogue, recognition of the role of the police officer in charge, recognition of specialized agencies, the need for restorative dialogue, etc. were investigated, and the results are as follows. First, as a difficult point as a police officer in charge, they cited schedule coordination with specialized agencies, a long time for restorative dialogue, lack of personnel in charge, and non-cooperation of detectives. Second, the police officers in charge thought that restorative dialogue should focus on resolving the conflict between the parties and recovering relations rather than compensation for damages, and that the success or failure of the restorative dialogue depends on whether or not the relations between the parties are restored, not whether they come to an agreement or not. Third, the police officers in charge should help the parties to express their honest feelings related to the dispute, and they thought it would be desirable to participate as an assistant host or observer in the restorative dialogue. Next, for the effect evaluation, the effectiveness of the restorative dialogue and the rewards from the restorative dialogue were investigated, and the results are as follows. First, the police officers in charge generally thought that restorative dialogue was more effective in recovering damage than the existing investigation procedures, and more effective in preventing recidivism than the existing investigation procedures. Second, a number of police officers in charge responded that they felt the rewards while operating a restorative dialogue program during the trial period. The results of this study have several policy implications. First, it is necessary to establish a clear purpose of restorative dialogue and publicize it. Second, it is necessary to establish a legal basis for the restorative dialogue program. Third, it is necessary to prepare a restorative dialogue host management system. Fourth, it is necessary to secure a sufficient pool of people who conduct dialogue. Fifth, it is necessary to secure the expertise of the police officer in charge. Sixth, it is necessary to prepare a morale relief plan for the police officer in charge. Seventh, it is necessary to establish a standard for restorative dialogue time. Eighth, it is necessary to establish a standard for incidents subject to restorative dialogue. Finally, there is a need for internal publicity of the police for the restorative dialogue program. This study examines the recent development and future prospects of the restorative justice systems in France, and tries to derive its implications for the development of the restorative justice in South Korea. We hope that this study serves as a basic data for legislative and institutional improvements which are essential for the vitalization of restorative justice in South Korea where it’s concept and mode of practice are not well known and practically deadlocked in spite of it’s various advantages and potentials.
