미국의 리엔트리 기반 출소자 사회복귀 정책 탐색 연구

일명 “리엔트리(Reentry)” 활동에 대한 중요도가 제대로 교정 현장에 마련되어있지 않은 상황이다. 출소 시점 전후에 범죄자를 위한 충분한 사회복귀, 재적응 활동이 리엔트리 속에서 체계적으로 마련되어 있지 않다면 출소자들의 재범률은 증가할수밖에 없다. 현재 우리나라에서 재소자들의 40% 이상이 이미 교도소 구금 경험이있는 전과자에 해당하고 출소 후 빠른 시간 내에 재범을 하는 것으로 나타났다. 출소자들이 사회에 제대로 적응하지 못하는 이유는 출소 전에 꼼꼼한 리엔트리 준비 과정을 거치지 못했기 때문이다. 이 연구는 미국의 출소자 사회복귀 정책을 검토하는데 목적이 있다. 미국의 제2의 기회법(the Second Chance Act) 내에서 출소자 리엔트리 활동이 어떻게 변화하고 발전해 왔는지 살펴보는데 주안점을 둔다. 이 연구에서 미국의 교정정책을 검토한 결과, 리엔트리 산업과 리엔트리 법원 등미국 사회복귀 트렌드를 범죄학 차원에서 검토해 보았다. 또한, 우리나라의 보호관찰 등에 관한 법률이 어떻게 새로운 법안으로 연결되어야 하는지 구체적으로 논의해보았다. 이 연구를 통해 “리엔트리(Reentry)” 차원의 교정시설-사회적응 사이의 전이 과정을 검토할 수 있고, 미국 리엔트리 법원(Reentry Court) 출현 배경을 보다 구체적으로 살펴볼 수 있다. 이 연구가 독자적인 한국형 “출소자 지원법” 출현을기대하는 밑거름을 만드는데 작은 도움이 되기를 바란다. 상세한 관련 내용은 본문에서 다루도록 한다.
Abstract
This study aims at investigating crucial advantages of inmates reentry and prisoners after care service policy of the United States. Few studies have been conducted regarding prisoner reentry policies and relevant laws in South Korea. Therefore the comparative view on the United States about prisoner reentry law and policy will be informative enough to initiate a new policy for helping inmates released rehabilitate and readjust into community in South Korea. The Second Chance Act of 2007 which was officially passed in States had articulated numerous provisions of assigning financial support for reentry interventions and structuring Reentry Court. Futhermore, the Second Chance Act had approved the mandatory pre-release custody center or halfway house in the community through the various articles of the law. The literature reviews on the comparative view of states demonstrated that the current rehabilitation plans and readjustment strategies for inmates released have limitations due to the lack of legal system and provision of relevant laws in South Korea. Further policy implications will be discussed.
