해방된 조선에 있어서 美軍政(United States Army Military Government in Korea;USAMGIK)이란 존재는 장래의 한국 정부를 수립하는 데 있어서 그 역할은 상당히 주목할 부분이다.군정이기 때문에 또한 그 군정청에서 발하는 법령들(포고(Proclamation), 法令(Ordinance), 部令(Department Orders) 및 局令(Bureau Orders), 指令(Bar Admisson), 行政命令(Executive Orders), 訓令(Instructions), 一般告示(General Notice), 公告(Public Notice), 規則(Regulation))의 종류는 상당히 중요한 의미를 가진다. 이러한 법령들이 3년간에 군정시기에 (남)조선에서 어떠한 역할을 하는가와 관련하여 그 중요한 부분들을 체계적으로 정리하고자 한다.그리고 이번에 특히 아직도 그 법령 때문에 문제가 되고 있는 朝鮮國防警備法(Articles for the Government of Korean Constabulary)과 朝鮮海岸警備法(Articles for the Government of the Korean Coast Guard;西紀 1946년 6월 15日附, 法令 第86에 依據;이하 조선경비법조선해안경비법(1946년)이라 칭함)의 자료가 발굴되었으므로 그 자료도 소개한다.본 논문의 연구하고자 하는 내용은 다음과 같다.Ⅰ. 序說 Ⅱ. 美軍政法令의 根據와 類型 Ⅲ. 「朝鮮國防警備法·朝鮮海岸警備法;西紀 1946年 6月15日;法令 第86号에 依據」의 자료 발굴(RG 407, 554에서) Ⅳ. 現存하는 美軍政法令集의 分析 Ⅴ. 美軍政廳 官報와 관련하여 Ⅵ. 본 美軍政法令集의 內容과 特徵
Abstract
The existence of USAMGIK(United States Army Military Government in Korea) functions as a considerably noteworthy role in establishing Korean Government in near future; All statues announced by the Army Military Government, such as Proclamation, Ordinance, Department Orders, Bureau Orders, Bar Admission, Executive Orders, Instructions, General Notice, Public Notice, Regulations and so forth, have a considerably importance significance in Korea. Concerning what roles these statutes played in (South) Korea during the period of three-year military government, I intend to keep the important parts in good order systematically in this theme. In particular, this theme is to cover newly-unearthed materials that are still controversial:“The Articles for the Government of Korean Constabulary” and “The Articles for the Government of the Korean Coast Guard” (Statute No. 86 on June 15, 1946) (Hereinafter referred to as AGKC·AGKCG 1946). What to be covered in this theme is as follows: I. Introduction II. The Basis & Classification of the United States Military Government Statutes III. The Analysis of the Existing United States Military Government Statute Book. IV. In Reference to the Official Gazette from the United States Military Government Office. V. About the time when AGKC and AGKCG (Statute No. 86 dated on June 15, 1946) are discovered (RG407, 554) VI. The Contents and Features of the United States Military Government Statute Book.
