Abstract
This article aimed to clarify the characteristics of the labour regime in the period of Pak, Chung-Hee government(1961-79), mainly focusing on the period of 1970s. It was proved by the analysis that the labour regime of 1970s under the ‘National Integrity Act 1971'(국가보위법) is remarkably different from that of 1960s. In 1970s the right of collective bargaining as well as the right to strike were denied for all workers under the name of ‘administrative mediation’(compulsory arbitration). It was a dramatic retreat from the combination policy of 1960s which legally approved the right to strike in private sector. The labour unions were almost wholly denied their essential functions even though their associations themselves were not directly prohibited. That regime corresponded to the political ‘Yushin-Cheje'(유신체제) which as a matter of fact repealed the modern Constitution system. As front supporters to that regime, the formal industry-based labour unions under the national peak union, ‘Hankook-Nochong’(KFTU), rather played terrible roles to control the rank and file workers. The regime of 1970s was characterized by the denial of the essential functions of trade unions, whereas it legally compelled the actors to establish the labour-management consultation system at the enterprise level so as to replace the independent unions. Consequently it was the regime of coercive integration.
