저작권법 재점검을 통한 디지털콘텐츠의 저작권 집중관리시스템에 관한 고찰

초록

본 연구는 디지털 컨버전스라는 변화된 커뮤니케이션 환경에서 저작물과 관련하여 새롭게 제기될 수 있는 규제 패러다임을 탐색해보고자 하였다. 이를 위해서 디지털콘텐츠와 관련된 저작권법을 살펴보고, 아울러 저작권법의 큰 틀 속에서 변화된 커뮤니케이션 상황에 적합한 콘텐츠의 생산과 유통을 규제하는 저작권 집중관리시스템을 재점검해 보고자 하였다. 한국의 저작권 집중관리시스템의 시급한 과제는 ‘저작권정보관리시스템’의 구축인데, 이를 통해 저작권에 대한 정보를 등록, 저장, 서비스를 제공하는 것이 필요하다. 이와 관련된 또 하나의 과제는 ‘표준 식별체계’를 갖추는 일인데, 이것은 디지털과 네트워크로 인하여 다종다량의 디지털콘텐츠의 통합검색과 신속한 관리가 절실히 필요하기 때문이다. 한국은 저작권신탁관리업에 대해서 동일분야인 경우 단수 체제의 원칙을 갖고 있으나, 현재의 허가제에서 등록제로 변경하여 신탁관리단체 간의 서비스 경쟁을 유도할 필요가 있다. 디지털과 네트워크로 인하여 지금까지 이종(異種)으로 분류되었던 저작물이 통합되고 있으므로 아날로그 방식에 의해 결성되었던 저작권 집중관리단체의 재편(통합)을 통해 저작권 집중관리시스템을 효율적으로 운영할 필요가 있다. 결국, 지금까지 저작물의 속성에 따라 저작권 집중관리단체가 분류되었으나, 앞으로 저작물의 분류와 관계없이 다양한 복수의 단체를 통해 저작자와 이용자 모두 혜택을 증진하는 방향으로 나가야 할 것이다.

Abstract

This study explores the regulation's paradigm regarding to digital contents under the changed communication settings. To this study, we are interested in the Copyright related with digital contents; at the same time, we research Collective Management of Copyright under the period of digital convergence. Collective Management of Copyright is challenged by the rapid development of digital technology. In Korea, Collective Management of Copyright needs to establish 'the copyright management information system', which registers, constructs, and services information related copyright. In relation to, Collective Management of Copyright need also to 'digital identifier' on the purpose of search and management of digital contents. The Korean Government support one Trust Management of Copyright in case of the same field, however, its need to compete among Trust Management of Copyrights. According to the rapidly increasing use of digital and network in contents, difference contents become to merge among them. Therefore, Collective Management of Copyright needs to reorganize its system in order to raise the efficiency of its management. Finally, so far Collective Management of Copyrights are divided following to contents' difference, however, there is urgent need for diverse Collective Management of Copyrights without contents' difference. Then, diverse Collective Management of Copyrights will lead to owe rights to contents' writers and receivers.
