Drunken people problem has basically two aspects. The first is the protection of drunken people. And the second is the punishment for drunken people who committed criminal offenses. Drunken people can be a victim of crime such as the theft and traffic accidents. Also drunken people can be the perpetrators of the assault. 21)But there are no rules that can handle properly the drunken people in the current Police Duty Enforcement Act. As a result, policeman is bound to respond negatively to escape their liability in the treatment of drunken people. There are two problems in the passive response to the drunken people. First, the lack of crime prevention and public authority is weakening. The second is the production of criminals. If policeman leave the drunk people, they commit crimes. So ex-convict can be mass-produced. To solve these problems, policeman's immunity should be given. And then policeman can handle drunken people problems aggressively. Therefore, indemnity provisions should be introduced such as exemption for the use of weapons, exemption for the use of equipments, exemption for personal injury, exemption for damages. But policeman's immunity should be recognized in the absence of intention or gross negligence.
