성폭력범죄자에 대한 지역사회 교정 적용모델

반복되는 아동 성폭력 범죄에 대한 강경대응 정책에도 불구하고 성폭력 전과자에 의한 재범이 계속 발생하고 있어 기존 지역사회 교정 및 범죄자 감독·처우에 대한 새로운 패러다임 변화가 요구되고 있다. 본 연구에서는 사회 안전(public safety)과 범죄자 치료(offender treatment)라는 교정의 두 가지 목적을 새롭게 조명하면서 상이한 특징을 갖고 있는 두 교정모델을 소개하고 지역사회에서 두 모델을 활용할 수 있는 방안을 논의하고자 한다. 본 글은 먼저 성폭력범죄자에 대한 지도․감독 틀로써 “지역사회 보호"(community protection)모델과 "공중보건”(public health)모델 두 가지를 설명한다. 그리고 위치추적 전자감시제도 이전과 이후의 성폭력범죄자 특성을 비교함으로써 강제적으로 모든 가석방 성폭력범죄자에게 위치추적 전자감시제도가 부과됨으로써 어떤 범죄자 특성 변화가 초래되었는지 간략히 살펴본다. 즉, 지역사회 보호모델의 하나로 여겨지는 전자감시제도가 2008년 9월 1일 이후 의무적으로 부과됨으로써 가석방 선별 단계에서 실제 더 고위험의 성범죄자가 프로그램 대상자로 선정되었는지, 혹은 비공식적 기제를 통해 위험하지 않은 특정 범죄자에게도 전자감시가 부과됨으로써 의도하지 않은 결과가 초래되었는지, 위치추적 대상자의 기본 특징을 살펴 교정모델 적용 필요성을 새롭게 고찰해보는 것이다. 빈도분석 결과, 전자감시 이후 성폭력범죄자가 연령, 교육수준, 범죄경력, 혼인 면에서 전자감시 이전 성폭력범죄자와 구분되는 특징을 갖고 있는 것으로 나타났다. 그리고 두 모델의 우위를 단순비교하기 보다는 사회보호 모델 이외에도 공중보건 모델 적용 필요성이 큰 것으로 나타났다. 사회보호 모델에 속하는 전자감시 제도가 간접적으로 어떠한 범죄자 특성을 초래했는지 살펴보고 향후 지역사회 교정모델이 성폭력범죄자 보호관찰에 어떻게 적용되어야 하는지 그 방향을 검토한다.
Abstract
The community-based correction of the released sex offenders has generated tremendous concern and issue in terms of public safety. The anxiety and fear of public and media toward the sex offenders made Korean Ministry of Justice initiate the new GPS electronic monitoring policy in 2008. This study seeks to introduce two different community correction models which are called "community protection model," and "public health model." By focusing on the characteristics of sex offenders who are placed on electronic monitoring, this study explores the two correction models to identify which model is more appropriate in preventing sex crimes in community. In addition, the article address critically the strengths and weakness of each model within the context of contemporary Korean community correction and practice in relation to the management of sex offenders. The article analyses the characteristics of 204 sex offenders who were assigned to the GPS electronic monitoring after they were released from prison in 2008. Furthermore this study assess the features of 230 released sex offenders who were referred to probation offices in 2007, when there was no electronic monitoring system in Korea. By comparing the characteristics of two different groups, this study can reflect the certain dynamic and mechanism that the new GPS electronic monitoring program might impact on the decision processes of the parole committee unconsciously or consciously. It will be argued that community protection model can be used for some of the most serious sex offenders while public health model can be applied to the relatively less serious sex offenders in community. Further consideration for the sex offender in community will be discussed.
