미국의 민영교도소의 쟁점에 관한 연구

이 연구의 목적은 미국의 민영교도소의 실태 및 문제점을 살펴보고 그 정책적 시사점을 이끌어내는 데 있다. 이러한 연구는 향후 우리나라의 형사정책의 바람직한 방향 결정에 기여할 것이다. 미국은 1980년대부터 마약과의 전쟁으로 시작된 구금처우의 확대에 따라 불가피하게 교정시설의 확장이 필요하였고, 그 과정에서 민간교도소 운영이 본격화 되었다. 그러나 일부 문제점이 노출되고 있어 다음과 같은 시사점을 얻을 수 있다. 첫째, 교정민영화의 지지론자들이 주장하는 것처럼 민영교도소의 출소자들의 재범률이 상대적으로 낮을 것이라는 기대는 이미 무너졌다는 점에서 재범률을 들어 민영교도소의 확대를 추진하는 일은 없어야 한다. 둘째, 교정기업은 이익창출을 위한 구금율 유지가 보장되어야 하는 바, 이는 비구금처우 및 회복적 사법이념, 지역사회교정활동 등의 형사정책 이념, 즉 공공적 가치와 충돌한다는 것을 인식해야 한다. 셋째, 교정의 민영화가 저비용 고효율 교정을 담보하지 못하며, 오히려 교정의 비전문화, 제한된 처우 등의 문제점이 따른다는 것을 간과해선 안 된다. 넷째, 민영교도소에 대한 감시감독이 어려워 수용자에 대한 인권침해의 소지가 있으며, 이에 대한 즉각적인 제재가 어렵다. 따라서 공공 교정시설 못지않은 감사체계와 투명한 기업공개 등이 담보되어야 한다. 다섯째, 국가형벌권을 수익사업 영역으로 인정할 수 있을 것인가에 대한 보다 신중한 사회적 논의가 이루어져야 한다. 교정의 민영화는 범죄자 처벌을 수익사업으로 민간에게 위탁하는 것으로 공공서비스 사업, 즉 철도청이나 우체국 등의 공익 서비스를 민영화하는 것과는 또 다른 차원이라는 점이 고려되어야 한다.
Abstract
The purpose of this study is to analyze the current status and problems of private prisons in the United States. This will contribute to prison privatization policy of Republic of Korea. Private prisons in the United States, there are the following problems. We should get lessons from them. First, proponents of prison privatization argue that private prison recidivism rates is low. However, it is an illusion. There is no difference in recidivism rates between the private prisons and public prisons. Second, the private prisons tend to increase detention period of inmates for making their profits. It is the natural behavior of the company. However, such the attitude of private prisons caused conflict with public values like incarceration, restorative justice ideology and community corrections. Because government pursue the rehabilitation of prisons. But the corporate want their interests. Third, the cost of private prisons is not lower than the national facilities. The privatization of the criminal justice can not insure the low cost and high efficiency. Rather private prisons have problems such as unprofessional service and limited treatment to inmates. Fourth, there is lack of transparency. CCA and GEO do not provide the information to the government. So government can not control the human rights violations against the inmates in private prisons. Fifth, we should seek social consensus regarding privatization of criminal process. There is a qualitative difference between privatization of criminal process with privatization of the postal service or railroad.
