Abstract

Recently, many countries, including the United Kingdom and the United Statesreduced intervention of state in accordance with privatize the administration ofcriminal justice based on neoliberalism. In contrast, Germany seem to enforce theprinciple of state responsibility such as maintain of preventive detention. In the case of Germany, criminal corrections is belongs to the public sector andalso social sentence is the responsibility of state except Baden-Wurttemberg. Theyalso defined the purpose of correction is re-socialization of criminal in prison law. And they emphasize country's role as a protector or helper to criminal. Furthermore, since 2008, imprisonment and preventive detention has been stressed against to morethan 14 years serious violent criminals including sex crimes. But in the May 4, 2011 the German Constitutional Court decided that preventivedetention to serious violent criminal is unconstitutional. And the German FederalConstitutional Court asked to Federal Germany government revised the penal codeuntil May 30, 2013. The probation is also belong to the ministry of state, but the type of organizationis very diverse and state government defined as a social sentence is one of socialwelfare work of state. Thus, we can evaluate that corrections and probation in Germany is based on theprinciple of state responsibility. And there are some character like organization'sdiversity, social services and strengthening of community treatment. This is veryimpacted to Korea want to introduce criminal justice privatization model thatcritically evaluated industrialization of criminal justice procedure in the UnitedKingdom and the United States.
