회복적 사법정의(Restorative Justice)에 근거한 교정복지 실천으로서 갈등중재 사례연구: Sycamore Tree Project를 중심으로

본 연구는 회복적 사법정의(Restorative Justice)에 근거한 교정복지 실천 방법으로 실시된 Sycamore Tree Project를 중심으로 효과성을 분석한 갈등중재 사례연구이다. 국내 최초로 실시된 본 프로젝트는 인테이크(intake) 단계, 준비 단계, 직접만남 단계, 보고 단계, 모니터링 단계, 그리고 사후조치 단계에 근거하여 시행되었으며, 직접만남의 단계는 회복적 사법정의에 입각한 7회기의 집단 활동으로 재소자 7명과 범죄피해자 5명이 참여하였다. 프로그램의 효과를 양적 연구방법으로 측정한 결과 참여한 재소자와 범죄피해자 모두 집단 활동 실시 전에 비해 통계적으로 유의미한 변화가 있었다. 구체적으로 말하면 집단활동 참가자들은 활동 전에 비하여 범죄에 대한 태도, 그들의 생각, 그리고 행동에 긍정적인 변화가 있었음을 알 수 있었다. 본 연구를 통하여 회복적 사법정의(Restorative Justice)에 근거한 갈등중재 프로그램의 효과성을 증명하였으며, 특히 피해자와 그 가족의 심리사회적 회복에 도움이 될 수 있는 토대를 마련하였다. 아울러 연구결과를 토대로 함의와 제언을 제시하였다.
Abstract
This is a case study of the conflict mediation through Sycamore Tree Project grounded on restorative justice as correctional welfare practice. The project is the first project implemented in this country, composing of phases of intake, preparation, direct encountering, reporting, monitoring, and follow-up. For the direct encounter, seven sessions of group activities with 7 inmates and 5 crime victims were carried out. The statistically meaningful effectiveness of the program by comparing before and after the group activities was shown in changes of the participants such as inmates and crime victims in the quantitative research method. To put it specifically, the attitudes toward crime, their thoughts and behaviors of those participants were changed meaningfully and positively after taking parts in the group activities. This study show the effective results of conflict mediation program based on Restorative Justice, particularly provides a basis for help the crime victims restore from their psychosocial trauma. Finally, based on the results of this research, several implications and suggestions were made.
