수형자와 가족 간 용서ㆍ화해 과정에서의 회복적 사법 가치 경험

본 연구는 수형자와 가족 간의 관계 회복을 위한 용서ㆍ화해 프로그램을 최초로 개발하여 적용하고, 회복적 사법 관점에서 그 효과를 탐구하고자 하였다. 연구는 프로그램의 기획, 설계, 실행, 평가 과정을 체계적으로 수행하며, 선행 연구의 검토와 수형자 및 출소자와 그 가족을 대상으로 한 10년 이상의 용서ㆍ화해 임상 경험을 바탕으로 총 7회기로 구성된 프로그램을 개발하였다. 프로그램의 효과성을 평가하기 위해 경기도 소재 S 교도소 수형자 3명과 그 가족, 진행자 2명을 대상으로 심층면접을 실시하였다. 자료 분석에는 반복적 비교분석법을 활용하여 참여자의 경험과 인식을 체계적으로 분석하고, 회복적 사법의 핵심 이념과 실천 가치인 공감, 존중, 용서, 화해, 책임의 경험을 심층적으로 탐색하였다. 연구 결과, 가족 간의 용서와 화해 경험은 수형자와 가족 모두의 심리적ㆍ정서적 치유와 관계 회복에 긍정적인 영향을 미쳤으며, 이는 대인관계에서의 인식과 태도 변화를 촉진하는 동시에 건강한 가정과 사회의 구성원으로서 재출발할 수 있을 가능성을 제시하였다. 본 연구는 용서ㆍ화해 프로그램이 회복적 사법의 가치를 실현하고, 개인 및 공동체의 사회적 통합을 촉진하는 데 중요한 기여를 할 수 있음을 입증하였다.
Abstract
This study first developed and applied a forgivenessㆍreconciliation program to restore the relationship between prisoners and their families, and explored its effects from a restorative justice perspective. The study systematically carried out the planning, design, implementation and evaluation process, and developed a program consisting of a total of seven sessions based on a review of previous studies and more than 10 years of forgivenessㆍreconciliation clinical experience for prisoners and their families. In order to evaluate the effectiveness of the program, in-depth interviews were conducted with three prisoners of 'S' prison located in Gyeonggi-do, and with their families and two program hosts. For data analysis, the researcher systematically analyzed the participants' experiences and perceptions using iterative comparative analysis methods, and explored in depth the experiences of empathy, respect, forgiveness, reconciliation and responsibility, which are the core ideologies and practical values of restorative justice. As a result of the study, the experience of forgivenessㆍreconciliation among family members had a positive effect on psychological and emotional healing and relationship restoration for both the inmates and their families, which promoted changes in perceptions and attitudes in interpersonal relationships while suggesting the possibility of restarting as a member of a healthy family and society. This study demonstrated that the forgivenessㆍreconciliation program can make an important contribution to realizing the values of restorative justice and promoting social integration of individuals and communities.
