회복적 사법 프로그램 효과성에 관한 탐색적 연구:소년 수강명령 대상자를 중심으로

본 연구는 소년 수강명령 대상자들에게 진행된 회복적 사법 프로그램의 효과성을 분석하는 것을 주요 목적으로 삼는다. 법무부는 2019년부터 자체적으로 소년대상 회복적 사법 프로그램을 제작하여 운영해왔고, 2020년에는 그 내용을 고도화하여 수강명령을 받은 소년들을 대상으로 40시간 회복적 사법 교육을 실시하였다. 총 27개의 보호관찰소의 참여로 운영된 소년대상 회복적 사법프로그램은 총 303명의 소년에게 40시간 동안 적용되었다. 이들을 대상으로 자기이해, 피해관련 지식, 피해자공감, 책임감, 수치심, 공동체의식, 보호관찰관에 대한 애착, 직·간접 재범억제력을 주요 개념으로 살폈고, 사전·사후 조사를 통해 이들 개념의 변화여부를 살폈다. 주요하게 활용된 통계기법은 t-test와 ANOVA 이다. 연구 결과 회복적 사법에서 주요 개념으로 설명하는 피해상식, 자기개념, 피해공감, 수치심, 책임감, 공동체 의식은 물론 범죄 억제력과 보호관찰관과의 애착에서 모두 유의미한 변화가 발견되었다. 집단별로 살펴보았을 경우, 성별 집단에 대한 차이는 거의 없었지만 중학생 집단의 변화가 고등학생 집단의 변화보다 컸고, 비행전력이 없었던 집단이 반대 집단에 비하여 변화량이 더욱 컸다. 즉 비행이 한참 진행된 학생들보다는 비행의 문턱을 넘기 시작한 소년들을 대상으로 회복적 사법의 효과가 더욱 강력할 수 있음을 확인하였다. 주요한 연구결과와 정책적 함의들은 본문을 통해 논의하도록 한다.
Abstract
The main purpose of this study is to analyze the effectiveness of the restorative justice program for juvenile who received education order. The Ministry of Justice has been producing and operating restorative justice programs for juveniles on its own since 2019, and in 2020, the contents were upgraded to provide 40 hours of restorative justice education for juveniles who were ordered to attend. The restorative justice program for juveniles operated with the participation of a total of 27 probation office was applied to a total of 303 juveniles. Self-concept, victim-related knowledge, victim empathy, responsibility, shame, sense of community, attachment to probation officers, and direct and indirect deterrence were examined as main concepts. The main analysis method used are t-test and ANOVA. As a result of the study, significant changes were found in victim-related knowledge, self-concept, victim empathy, responsibility, shame, sense of community, as well as crime deterrence and attachment to probation officers, which are the main concepts in restorative justice. When compared each group, there was little difference in the gender group, but the change in the middle school group was larger than that in the high school group, and the group with no criminal history had a significant change than the opposite group. In other words, it was confirmed that the effect of restorative justice could be stronger for juveniles who started to cross the threshold of delinquency than for juveniles who had criminal careers. The main research results and policy implications are discussed throughout the main context.
