국방 무기체계 연구개발 및 양산사업 수행간 계약상대자가 정당한 이유 없이 기한내 계약상의 의무를 다하지 못하면 정부는 상응한 지체상금을 부과하고 있다. 그러나 과도한 지체상금 부과는 방산업체를 파산이나 도산에 이를 수 있어 이를 분석 및 검토 해야할 시점이 되었다. 따라서 본 연구의 목적은 국방 무기체계 계약 불이행에 대하여 과도하지 않은 적정 지체상금을 부과할 수 있는 정책적 제언을 제시하고자 한다. 이를 통해 방위산업의 발전과 방산업체 보호육성을 하고자 한다.
Abstract
The government imposes a corresponding delay compensation if the counterpart fails to fulfill the contract obligations within the deadline without a justifiable reason during toe R&D and mass-production programs of the defence weapons system. However, the imposition of excessive compensation could lead to bankruptcy of defence companies, which is the time to analyze and review them. therefore, the purpose of this study is to present policy suggestions for imposing an adequate, if not excessive, if not excessive, delay compensation for non-compliance of the Defence Weapons System contract. Through this, the government aims to delay the defense industry and nurture defence companies.
