공공공사 입찰 담합 가능성 결정요인 분석:기술형입찰을 중심으로

초록

본 연구는 국내 공공공사 기술형입찰에서의 담합 유인을 살펴보고 담합에 영향을 미치는 요인들에 대해 실증분석한다. 본 연구에서는 담합을 유발할 수 있는 제도적·환경적 요인 등을 다수 도입하여, 각 요인들이 입찰 담합에 영향을 미치는지 여부와 그 효과의 정도를 분석하였다. 추정 결과, 동시분할발주사업 수, 1사1공구제 적용 여부가 모형에 관계없이 담합 가능성에 유의한 영향을 미치는 것으로 나타났다. 특히 동시분할발주사업 수가 1건 증가할수록 담합 확률이 평균 2.1%p∼2.8%p 높아지며, 1사1공구제를 적용한 입찰의 담합 확률은 그렇지 않은 입찰 대비 평균 12.6%p∼16.1%p까지 상승하는 것으로 추정되었다. 본 연구의 분석결과들은 입찰제도적 특성을 비롯한 입찰 특성이 담합 가능성을 높일 수 있는 만큼 입찰제도 설계에 주의를 기울일 필요가 있음을 시사한다.

Abstract

This paper examines various factors that affect collusion in procurement auctions for public works. Estimation results show that the number of simultaneously ordered projects and “one firm, one project” policy are statistically significant on the probability of collusion. When the number of simultaneously ordered projects increases by one, the probability of collusion increases by 2.1%p to 2.8%p on average. The probability of collusion increases by 12.6%p to 16.1%p in bidding with “one firm, one project” policy compared to the bidding without it. Estimation results suggest important implications on the design of the bidding system to prevent collusion.
