星湖 李瀷의 人法相維의 정치사상: 덕치, 법치, 형치 관념을 중심으로

Abstract

This thesis examines a study to manage and better the world (經世致用學) of Seong-ho Lee-Ik (星湖 李瀷) focusing on theories on governance by virtue (德治) / governance by law (法治)while it also demonstrates a point that Seongho revised / legislated and theorized principles of governance by penalty (刑治) and provisions in accordance with governance by virtue and supplementation with punishment (德主刑輔) on laws of the time. In that sense, his worry on governance by law was another expression for his worry on governance by virtue. In other words, this means that Seongho’s theory of governance by virtue was governance by law with minimum penalty based on compulsion and, pursuit of governance by virtue with governance by law at maximum based on agreement on a consensus of public opinion (順民), and governance by law for the ruled at the same time. This very aspect enabled him to secure his status of a representative Silhak scholar (scholar of the Realist School of Confucianism) in the study to manage and better the world which was for Renaissance of Confucianism in late Joseon.
