우리나라 노사관계 시스템이 가지고 있는 특징 중의 하나가 조정전치주의를 도입하고 있는 것이다. 우리나라 노사관계 시스템을 설명하는데 있어 중요한 변수가 되고 있음에도 불구하고 관련연구는 많이 미흡했다. 이 연구에서는 노동위원회가 제공하는 공적조정서비스의 효과성에 영향을 미치는 요인에 대해 분석을 시도하였다. 이 연구에 사용되어진 자료는 2007년 노동분쟁이 발생해 노동위원회에서 조정서비스를 제공받은 사업장을 모집단으로 하여 노동조합 128개, 사용자 117 총 245개설문지를 수집․분석하였다. 노동조합과 사용자 표본을 분리하여 분석한 결과 조정위원 능력이 조정효과성 지표로 설정한 조정성립과 노사관계 개선 두 종속변수에 유의하게 긍정적 영향을 미치는 것으로 나타났다. 평상 시 노사 간 대화․협의 활발성 등은 노동조합과 사용자 일방에서만 긍정적 또는 부정적 유의성이 나타났다. 이러한 연구결과는 조정의 효과성 핵심지표가 조정위원의 능력임이 다시 한 번 확인되었다. 또한 분쟁조정 과정에서 조정인은 노동조합과 사용자에 대한 조정전략을 차별화해야 함을 시사해 주었다. 향후 연구에서는 이를 토대로 조정의 효과성을 촉진시켜주는 조정인의 세부적인 특성(긍정적 정서, 자기효능감 등) 및 인적속성 등에 추가적 실증분석의 필요성을 제기해 주었다.
Abstract
Korea's industrial relations system has one of the features that disputants must mediate about their labor disputes before strike. Mediation is important variables to describe the system of labor relations in Korea, despite the lack of a lot of research. In this study, we tried to analyze factors affecting the effectiveness of Mediation Services. As mode of data collection, the survey is conducted on targeting the workplaces, having provided mediation service in 2007, and among them, 245 questionnaires were collected and analyzed. In this study, we analyzed samples separated by the labor unions and employer. As the result of analysis, two indicators established industrial relations improved and completion od mediation to measure effectiveness of medation are affected by mediators' ability of the Labor Relations Board. Namely, mediator‘s ability is strong positive impact in labor dispute mediation. Vitalization of usual dialogue between labor and employer showed only a positive or negative significance. These findings match results of precedence researches that claimed key indicators of mediation effectiveness on the ability of the mediators of the Labor Relations Board. Lastly, the author recommends need of further research about mediator's detailed characteristics(positive affectivity, self-efficacy etc) to promotes the effectiveness of the mediation.
