스토킹 규제 및 피해자 지원에 관한 미국 법체계와 시사점: 뉴욕주를 중심으로

스토킹 범죄의 심각성과 입법적 미비 등에 대한 국민적 공감대에 기초하여, 「스토킹범죄의 처벌 등에 관한 법률」을 제정·시행하고 있으나, 사회적 이목을 끄는 심각한 스토킹 범죄는 지속적으로 발생하고 있다. 스토킹 관련 법제도의 실효성을 높이고 개선점을 제안하기 위해, 본 연구는 스토킹에 대한 입법이 비교적 이른 시기에 이루어진 미국의 스토킹 관련 법제도를 검토하였다. 스토킹에 대한 규제 및 개입, 그리고 피해자 지원제도를 연방과 주 차원으로 나누어 살펴보았다. 연방 차원에서는 연방 형법과 여성폭력방지법을 중심으로, 주 차원에서는 뉴욕주의 형법, 형사소송법 등을 중심으로 주별 입법 내용을 분석하였다. 이에 기초하여, 본 연구는 스토킹 규제의 대상이나 범위를 적응적으로 보완할 것을, 여러 조직에 산재되어 있는 피해자 지원제도를 조정할 수 있는 제도를 마련할 것을 제안하였다. 또한, 다양한 스토킹 관련 법규나 제도의 효과성을 평가할 수 있는 제도를 마련하여 제도 운용의 실효성을 높일 것을 제안하였다.
Abstract
Based on the societal awareness of the seriousness of stalking crimes and legislative shortcomings, the 'Act on the Punishment of Stalking Crimes' has been recently enacted and enforced in South Korea. However, despite the enactment of this law, severe stalking crimes that capture public attention continue to persist. In order to enhance the effectiveness of the stalking-related legal framework and propose improvements, this study aims to review the stalking-related legal systems in the United States, where legislation was enacted relatively early, to regulate and intervene in stalking, as well as to provide support for victims. This study differentiates between federal and state levels, focusing on federal criminal law and the Violence Against Women Act at the federal level, and examining the criminal law and criminal procedure law of New York State at the state level. Building on this analysis, this study seeks to derive insights for domestic legislation in the Republic of Korea. Based on these insights, recommendations include adapting the scope and targets of stalking regulation, establishing a coordinated system for victim support currently dispersed among various organizations, and proposing the creation of mechanisms to evaluate the effectiveness of diverse stalking-related laws and regulations, thereby enhancing the operational efficiency of the legal framework.
