2015년 12월 28일 한국과 일본의 외교장관은 회담을 열고 일본군 ‘위안부’ 문제에 대한 ‘최종적ㆍ불가역적’ 해결을 선언하는 합의사항을 발표하였다. 그러나 그 합의사항은 기본적으로 피해자의 입장이 반영되어 있지 않을 뿐 아니라, 인도에 반하는 범죄행위에 대한 국제적 규범에 부합하지 않는다. 이 글은 그 합의와 관련된 문제의 상황을 직시하면서 과거 제국주의 국가의 식민지 지배와 전쟁으로 인한 범죄행위에 대해 어떤 해결책이 가능한지 모색한다. 이 글은 먼저 한·일간의 과거사 인식의 문제를 다루는 한편, 일찍이 독일의 전후 책임의 문제를 ‘죄의 문제’로 깊이 있게 다룬 카를 야스퍼스(Karl Jaspers)의 입장을 참고하면서 제국주의 국가의 반인도적 범죄행위에 대해 어떻게 접근해야 하는지를 다룬다.
Abstract
On December 28th 2015, the foreign ministers of Korea and Japan announced an agreement that declares a ‘finalㆍirreversible’ resolution to the Japanese military sexual slavery issue. But the agreement is not only not been basically reflect the position of the victims, it does not conform to international norms for a crime against humanity. This article is noting the situation of issue related to the agreement, and deals with the issue of responsibility for the criminal acts caused by the war and the colonial rule of the past imperialist nations. Firstly this article deals with issue of recognition of the past history between Korea and Japan. Then this article introduce the position of Karl Jaspers discussed in depth the issue around responsibility of the post-war as ‘the problem of sin’ in Germany, and deals with the issue of responsibility for crimes against humanity caused by the past imperialist nations.
