가상자산과 블록체인 기술은 디지털 경제의 핵심 요소로 부상하고 있다. 본 논문은 미국의 주요 가상자산 관련 법안인 21세기를 위한 금융혁신 및 기술법안, 책임 있는 금융 혁신 법안, 블록체인 규제 명확성 법안을 중심으로 미국의 디지털 자산 시장의 규제와 혁신 간의 균형을 분석하고, 이를 바탕으로 한국의 정책적 방향성을 제시한다. 미국은 디지털 자산의 법적 정의와 분류, 스테이블코인 규제, 시장 투명성 강화를 위한 포괄적 접근을 취하며, 특히 비트코인과 이더리움 현물 ETF의 승인을 통해 가상자산의 제도권 편입을 허용한 상태이다. 반면, 한국은 가상자산 이용자 보호법을 시행하여 투자자 보호와 거래 투명성을 강조하고 있으나, 발행자 규제 및 스테이블코인 등에서 입법 공백이 존재한다. 본 논문은 미국의 가상자산 입법과 정책 동향을 기반으로 한국 디지털 자산 시장의 지속 가능한 발전을 위해 규제 명확성과 혁신을 지원하는 법적 프레임워크 마련의 필요성을 강조한다. 이를 통해 디지털 자산 시장의 신뢰를 강화하고 국제 경쟁력을 확보할 수 있는 기반을 제공하고자 한다.
Abstract
Cryptoassets and blockchain technology are emerging as key elements of the digital economy. This paper analyzes the balance between regulation and innovation in the digital asset market in the United States, focusing on the major virtual asset-related bills in the United States, the Financial Innovation and Technology Act for the 21st Century, the Responsible Financial Innovation Act, and the Blockchain Regulatory Clarity Act, and presents the policy direction of Korea based on this analysis. The United States has adopted a comprehensive approach to legal definitions and classifications of digital assets, stablecoin regulations, and strengthening market transparency, and has allowed the institutional incorporation of virtual assets by approving spot ETFs for Bitcoin and Ethereum. On the other hand, South Korea has implemented the Virtual Asset User Protection Act, emphasizing investor protection and transaction transparency, but there are legislative gaps in issuer regulation and stablecoins. The United States has taken a comprehensive approach to legal definitions and classification of digital assets, stablecoin regulation, and strengthening market transparency, and has allowed the institutional incorporation of virtual assets, especially through the approval of spot ETFs for Bitcoin and Ethereum. This paper emphasizes the need to establish a legal framework that supports regulatory clarity and innovation for the sustainable development of the Korean digital asset market based on the US virtual asset legislation and policy trends. This will strengthen the trust in the digital asset market and provide a foundation for securing international competitiveness.
