본 연구는 중소기업의 경제적·사회적 역할을 바탕으로, 중소기업 지원 정책의 이론적 근거를 정책가치 관점에서 분석하였다. 공정성, 형평성, 효율성, 혁신성, 지속가능성의 다섯 가지 정책가치를 중심으로 관련 법률을 검토한 결과, 대부분의 법률이 효율성에 중점을 두고 있으며, 혁신성과 지속가능성도 중요한 가치로 나타났다. 헌법과의 정합성 분석을 통해 공정성, 형평성, 효율성, 지속가능성이 포함되어 있으나, 혁신성은 효율성에서 파생된 개념으로 법률에서 보완되고 있음을 확인하였다. 본 연구는 법률의 정책가치 정합성 강화를 통한 내적 효율성 증대를 위한 방안을 제시하며, 중소기업의 지속가능한 성장을 지원하는 데 기여할 것으로 기대된다.
Abstract
This study analyzes the theoretical foundations of policies supporting small and venture enterprises based on their economic and social roles, from the perspective of policy values. By examining relevant laws centered on five policy values-fairness, equity, efficiency, innovation, and sustainability-it was found that most laws emphasize efficiency, while innovation and sustainablility also emerge as significant values. Through an analysis of consistency with the Constitution, it was confirmed that fairness, equity, efficiency, and sustainability are encompassed, whereas innovation is addressed as a derivative concept of efficiency within the laws. The research proposes measures to strengthen the alignment of policy values in legislation and to enhance internal efficiency, anticipating contributions to the sustainable growth of small and venture enterprises.
