기술사회의 위험을 인간과 기계의 대립 구도로 접근하면 인공지능(Artificial Intelligence, 이하 ‘AI’)에 기반한 저널리즘은 인간의 고유한 가치평가 영역을 기계에 내어준다는 점에서 그 대립이 도드라지는 분야이다. 오늘날 저널리즘 영역에서도 AI의 활용이 시도되고 있다. 빅데이터와 알고리즘을 축으로 하는 AI에 기반한 저널리즘은 뉴스콘텐츠를 작성･제작하는 영역 및 배포･노출 등 제공하는 영역으로 구분될 수 있다. 전자의 대표적인 예는 데이터의 수집 및 분석을 통한 예측･탐사･분석 보도이며 후자의 대표적인 예는 이용자의 데이터를 기계적 알고리즘으로 그루핑(grouping)한 맞춤형 뉴스서비스가 있다. AI에 기반한 저널리즘은 콘텐츠 생산과 제공에 효용성을 높인다. 반면 편향된 정보를 기계적으로 제공함에 따라서 알 권리 표현의 자유 등 수용자의 정보기본권을 침해할 우려가 있다. 아울러 가짜뉴스(fake news) 등을 판별하기 위한 AI를 활용한 필터링은 공적 표현의 자유를 과도하게 위축시킬 수 있다. 현재 AI는 발전 단계에 있어서 관련 규제 마련이 어려운 실정이나 AI 활용으로 인한 문제점을 규율하는 법제화의 방안은 계속해서 연구가 필요한 영역이다. 기술의 초기단계에서는 섣부른 입법을 보다 관련 기본권의 구체적인 보호범위를 조망해볼 필요가 있다. 아울러 AI기반 저널리즘의 기본권 간 충돌상황에 대한 해결방안으로 국가의 소극적 부작위에 관한 심사기준을 강화하는 헌법상 노력이 필요해 보인다. 본 연구는 AI에 기반한 저널리즘에서 발생하는 법적 문제를 특히 헌법에서 보장하는 기본권의 개념과 보호의 관점에서 조망하였다. 아울러 헌법의 실천적 과제로서 사인 간의 기본권의 충돌을 해결하기 위한 기본권 보호의무 심사기준으로 과소보호금지원칙을 전향적으로 적용하는 방법과 정보의 자유로서 자기결정권의 보호범위 획정을 제안하였다.
Abstract
When approaching a technological society’s risks from a confrontational structure between humans and machines, journalism based on artificial intelligence (AI) is an area where confrontation gives away the unique areas of human valuation to machines. Nowadays, AI use in journalism is being attempted. Such journalism based on AI, which is subsequently based on big data and algorithms, is accessed in areas where news content is written and produced and where news is distributed (arrayed) and exposed. Some examples of the former include forecasting, exploration, and analysis reporting through data collection and analysis. Meanwhile, customized news services that group user data into mechanical algorithms are an example of the latter. Fears surrounding AI-based journalism stems from bringing utility to content production and delivery while threatening inmates’ privacy and violating their fundamental rights by providing biased information mechanically. In addition, filtering using AI to identify fake news in journalism can excessively dampen the freedom of public expression. Currently, preparing regulations related to AI development is difficult because legislation designed to regulate problems caused by AI utilization is an area where research is continuously needed. In the early stages, details on specific fundamental rights need to be confirmed in the constitution before legislation can be drafted. In addition, constitutional efforts are needed to strengthen screening standards on the side effects before creating a solution to the conflict between fundamental rights and AI-based journalism. This study examines the legal problems arising from AI-based journalism, especially on the concept and protection of fundamental rights guaranteed by the constitution. In addition, the constitution proposes the prospective application of the Underprotective Prohibition as Judicial Review Standard Principle to resolve conflicts involving fundamental rights between signatories. This proposal also requires establishing a scope of protection for self-determination as freedom of information.
