Abstract

Personal webcasting is a new form of media that uses the telecommunication methods of letters, numbers, graphics, sounds, photos and videos. Personal webcasters interactively broadcast with users in real time. Webcasting systems do not need to install new lines and thus have low costs. This means that anybody can use that system to broadcast information as well as his or her opinion. Such content can be widespread because it is open to the public for free. Further, anybody can participate in a personal broadcasting system and easily spread such content using smart-phone applications. To protect and regulate the freedom of expression, we need to figure out its feature on the view point of the model of the media control. This new form of media makes it possible for minority groups to rapidly and extensively express opinions and related facts that oppose those of the majority through Internet broadcasting. Personal webcasting provides a platform for free speech and represents the decentralized and open structure of the Internet. Speech through such webcasting systems must also be protected by the constitutional clause of freedom of speech. Regulation for that speech has to follow constitutional principles in the priority of national security > social order > public good. National security may provide an easy case for the restriction of free speech through personal webcasting, but social order needs to be thoroughly scrutinized. To limit freedom of speech, the laws also have to abide by constitutional principles such as restriction by Act, the principle of clarity and the principle of proportion. When the freedom of speech of personal webcasters collides with personal rights of others, the justification clause for defamation under criminal law can be applied. However, for the case of defamation against a public figure, the free speech right of the webcaster has to be extensively protected. Generally speaking, however, webcasters usually spread their personal opinions or interests via a webcasting system and do not typically pursue public interests. Thus, it is not easy to acknowledge the neutrality or public goods of personal webcasting. As a result, the doctrines of Void for Vagueness and Clear and Present Danger cannot be applied to personal webcasting. This means that we can more widely restrict their free speech, especially when compared with traditional newspapers or broadcasting systems. The speech of personal webcasters is restricted by the ACT ON PROMOTION OF INFORMATION AND COMMUNICATIONS NETWORK UTILIZATION AND INFORMATION PROTECTION, ETC. This act prohibits the circulation of content related to intrusion on privacy, defamation, obscenity (unpunishable by the Criminal Act because information is not a tangible object), unwholesome medium for juveniles under the Juvenile Protection Act, speculative activities, and committing activities of the National Security Act. The Communications Commission and the Communications Standard Commission also regulate illegal information through the Act on the Establishment and Operation of Korea Communications Commission. Generally speaking, personal webcasters and Internet broadcasting platforms are not traditional forms of media, so they don't need to follow the corresponding regulations for traditional media, such as confirming the real names of online users. A citizen who insists that his or her personal rights are violated by personal webcasters can appeal to the self-regulation of internet broadcasting or concerned administrative authorities such as the Communications Commission and the Communications Standard Commission. A citizen can also utilize the mediation programs and civil, administrative litigation procedures offered by the courts. Sometimes, a citizen can file a charge at a police station or a prosecutor's office against the personal webcaster. I strongly suggest that most cases regarding personal webcasting should be handled by the Press Arbitration Commission. The new media of personal webcasting needs to discuss about the balanced protection for the free speech of webcasters and the personal rights of the citizens. I hope to gather enough different cases to effectively solve the problem of protecting and regulating the free speech of personal webcasters.
