근래 개정된 상법 제4편 보험계약법은 주로 가족에 대한 보험자의 보험대위 금지(개정법 제682조제2항), 책임보험 피보험자의 배상청구사실 통지의무 위반의 효과(개정법 제722조제2항)에서처럼 판례로 형성된 법리를 법전에 도입하고 있으며, 나아가 심신박약자의 생명보험 가입 금지 등 문제점이 지적되어 오던 사항을 개선하고 있다. 이처럼 보험계약법은 보험제도의 운영상 나타난 일부 미비점을 개선하고 법규정상 해석이 모호했던 부분에 관한 판례의 입장을 입법화하는 등 법적 불확실성을 보완하기 위한 노력을 하고 있으나 몇몇 조문의 경우 시행도 되기 전에 문제점이 지적되고 있다. 그러한 논란대상으로 보험대리상 규정(제646조의2) 및 심신박약자의 사망을 보험사고로 하는 생명보험계약 및 관련 단체보험계약에 관한 규정(제732조 단서)이 거론된다. 따라서 개정 보험계약법 시행 전에 이들에 관한 법적 불확실성을 정비할 필요가 있다.
Abstract
Korean insurance contract law (Part IV of Korean Commercial Act) was revised in March this year and will be enforced after one year from its enactment. It introduces some legal principles formed from judicial precedents by Korean courts. Furthermore, it also improves some issues such as decline of insurance against feeble minded persons which had been criticized by people both inside and outside of academic world. This newly revised insurance contract law tries to supplement some loop holes found in its application process thereby making up for legal uncertainty caused from imperfections of the law. However, a few legal provisions are, even before its enforcement, found to have some problems that cannot be overlooked; the provision of insurance agent (article 646-2) and life insurance contract for third person who is feeble minded person (the proviso of article 732) arguably have points in dispute in both interpretation and application, being at the center of hot controversy. Therefore, this legal uncertainty needs to be reexamined and adequately removed before their enforcement scheduled in next March.
