본 연구는 난민제도가 단지 국제정치와 보편적 윤리의 관점에서 논의되는 것을 넘어, 국가 내부의 정치적·사회적 역동과 제도 영역에서의 관습과 문화의 영향, 그리고 관련조직간의 관계와 위계 구조 등의 요소가 중요한 역할을 한다는 점을 강조하며 이를 통해 난민과 난민제도에 대한 담론의 폭을 확장 및 심화시키는 데 목적을 둔다. 이를 위해 난민 행정 체계와 조직적 맥락을 분석하고, 이 과정에서 나타나는 관행과 실천의 역동성을 조명하며, 한국 난민 제도의 주요 특징으로서 임시방편적 성격과 제도간 불협성을 논의한다. 특히 심사 전문성과 신속성에 대한 강조가 개별 공무원의 책임성에 대한 요구로 이어지면서 조직 및 운영의 재구성을 더욱 어렵게 만드는 한계를 지적한다. 난민 제도를 시행해온 다른 국가들에 비해 그 제도적 역사가 짧은 한국에서, 이주민의 규모에 비해 충분히 발전되지 못한 비자 체계와 명확한 방향성이 결여된 난민 정책의 현실 속에서, 난민 제도의 실행 영역에서 발생하는 충돌과 비일관성을 분석하고, 이를 개선하기 위한 방향을 모색한다.
Abstract
This study examines how refugee issues, typically framed through universal ethical principles, are actually embedded within complex institutional webs shaped by a country’s political and social dynamics, as well as customs and culture of its institutions. The study argues for broadening the discussion of refugees and refugee systems by focusing on concrete institutional practices. It analyzes the refugee administration system and organizational context, emphasizing the dynamics of practices and relationships among institutions, organizations, and personnel. Korea’s refugee system is relatively new, which creates noticeable problems with policy coordination and inconsistent practices. The country’s visa systems haven’t kept pace with the growing size and importance of its migrant population, and refugee policies still lack clear direction, making these issues even more apparent.
