Abstract
Patent is given to invention while the patent eligibility of the invention is not well-defined especially for the business method and computer program-related inventions. The schemes putting the restriction on eligible inventions can be categorized into two: one that is based on the requirement of establishment as invention as adopted in Korea as well as Japan and the other scheme based on the subject matter patentability as incorporated in the United States. Under the former scheme, whether the natural law is utilized or not plays as key role for the establishment as eligible invention. This requirement to utilize natural law to be an eligible invention, however, seems in short of sufficient logical grounds besides formal logics. Under the subject-matter patentability scheme, process is defined as one of the eligible subject matters while the scope of the process is not well-defined as the scope of the eligible process is drastically changed from the so called useful-concrete-tangible result to the machine-or-transformation criterion by the Supreme Court of the United States through the opinion of the Bilski case. Nevertheless abstract idea represented by natural law and mathematical algorithm are consistently excluded from the eligible subject matter. This makes us to find the logical ground for the exclusion from the proposition that abstract ideas as contrary to the concrete application to be laid to the public not to be taken exclusively as fundamental building blocks for the progress of science and technologies.
