국어학적 관점에서 본 대법원 판결서의 문체 개선 방향

법령을 일반 국민도 알기 쉽게 개선하기 위해 기울여진 노력을 참고하여, 대법원 판결서를 보다 알기 쉽게 하기 위한 문체 개선 방향을 국어학적 관점에서 모색해 본다. 문장 차원에서는 조사, 어미, 부사, 접속사 등을 정확하게 사용하고, 표현을 간결화·명료화할 필요가 있다. 특히 부정 표현이 들어 있거나 복문 구조를 내포하고 있는 경우, 독자의 인지적 부담이 크므로 그러한 노력이 더욱더 요구된다. 문단 차원에서는 문장의 길이를 좀 더 짧게 하고, 사실이나 논거를 나열할 때 번호를 붙여 위계적으로 항목화하고, 두괄식 구조를 더 적극적으로 사용하고, 각 절에 제목을 붙이는 방안을 제안한다. 또한 사건의 개요를 한눈에 파악할 수 있게 해 주는 시각적 장치도 판결서 또는 그 첨부자료에서 시도할 필요가 있다.
Abstract
Efforts have been made to facilitate the public’s understanding of laws and legislations by making improvements. Based on such efforts, this paper seeks to find ways to improve the style of the Supreme Court’s written judgments from the standpoint of the Korean linguistics. At the sentence level, correct use of particles, verbal endings, adverbs and conjunctions are proposed; also, expressions need to be simplified and clarified. Such considerations are especially required in cases where sentences are composed of negation or an embedded structure, which weigh heavily on a reader's cognitive load. At the paragraph level, it is proposed to (i) make sentences shorter; (ii) itemize facts, arguments or grounds in a hierarchical order; (iii) put conclusions first; and (iv) to attach titles to each section. In addition, using a visualization tool to provide a quick overview of the case at hand may be considered in written judgments or attachments thereto.
