특허의 경과기간과 활용 가능성에 대한 실증분석과 시사점

본 연구에서는 특허 등록(또는 출원) 이후의 시간 경과와 특허의 활용 가능성(또는 가치) 간에 상당한 상관관계가 존재한다는 가정하에 일반적으로 특허 등록(또는 출원) 이후 어느 시점에서 특허의 관리 및 활용 전략이 달라져야 하는지를정량, 정성 분석을 통해 살펴본다. 분석의 주요 결과는 다음과 같다. 첫째, 특허의 이전 시점을 분석하였을 때 국가 연구개발 사업 성과물로 창출된 특허기술의 경우에는 등록 이후 1.61년, 국가연구개발 사업 성과물이 아닌 경우에는 등록 이후 5.11년 이내에 90%가 이전되는 것으로 나타났다. 즉, 등록 이후 5년이 지난 특허의 경우 특허의 이전 가능성이 현저히 낮아진다는 것이다. 둘째, 기업의 66.7%, 대학·공공연구기관의60.3%는 등록 후 5년 또는 그 이전에 특허의 활용 가능성이 현저히 떨어진다고인식하고 있는 것으로 나타났다. 이는 5년이 경과한 경우에 특허의 활용 가능성이 떨어지기 때문에 특허 거래나 활용 가능성 제고를 위해 정부 정책이나 기관,기업 전략의 목표나 내용들이 달라져야 함을 의미한다. 본 연구의 결과는 기술이전·사업화 정책에서 중요한 문제의 하나이지만 그 기준이 명확하지 않았던 미활용 특허의 범주에 대한 합리적인 기준을 제시할 수 있다는 점에서도 의의가 있다.
Abstract
Based on the assumption of high correlation between the time elapsed from the registration (or application) of patent and the vale of patent, this study conducts quantitative and qualitative analyses to examine when the patent management or exploitation strategies should be changed. The main results are as follows. First, the 90% of the licensed patents generated from public R&D programs were transferred to private firms within 1.61 years and the 90% of the licensed patents generated from private R&D programs within 5.11 years. It indicates that the transfer possibility of patent after 5 years from registration becomes remarkably low. Second, the 66.7% of enterprises and the 60.3% of universities and public research institutes perceive that patents rapidly depreciate after 5 years from registration. The results of this paper imply that the public policy and management strategy for promoting patent license and utilization should be changed at certain points. Furthermore, the standardization of the criteria for detecting sleeping patent based on the time passed from patent registration would mitigate the negative effect caused by discrepancy in the criteria of sleeping patent, and also increase the effectiveness of public policy for promoting patent license and utilization.
