2000년 4월 WIPO는 유전자원 이익공유와 특허제도의 절충점을 찾기 위해 “지식재산, 유전자원, 전통지식 및 민간 전승물에 관한 정부간위원회”를 출범시켰으나, 제43차 회의(2022년 5월)까지 20년 넘게제자리를 맴돌았다. 이러던 중, 2022년 7월 개최되었던 제63차 WIPO 총회에서 이에 대한 외교회의를2024년에 실시하기로 결정하였다. 이러한 급격한 상황 변화에 따라 우리나라는 그간 견지해온 기존의펀더멘탈을 공고히 하면서 국제적 변화의 흐름에 부응하는 유연하고 창의적이며 국익 지향적 자세를수립해야 한다. 이러한 견해에서 바라보는 출처공개제도는 다음과 같다. 출처공개제도는 “특허제도의 발전”이란 방향성에 따라 수립 및 실시되어야 한다. 이러한 분명한 방향성에 따라 관련 문안은 특허청과 지식재산 사용자가 실질적이고 효율적으로 활용할 수 있을 정도의 법적 명확성을 담보해야 한다. 또한 이러한 주체들에게 부수적이고 불합리적인 추가 비용을 발생시켜서도 안 된다. 이러한 방향성 아래 문안은 다음의 네 가지 기본원칙에 따라 구성되어야 한다. 첫째, 특허제도의 실용적인 발전을 도모할 수 있는 내용으로 구성되어야 한다. 둘째, 출처공개 의무가 발생하는요건은 보다 명확하고 실질적인 내용으로 구성되어야 한다. 셋째, 제재와 수단은 적절한 내용으로 구성되어야 한다. 넷째, 출처공개제도가 국제적으로 조화롭고 합의된 약속으로 자리 잡을 수 있는 내용으로 구성되어야 한다.
Abstract
At the 63rd WIPO General Assembly in 2022, it was decided to hold a diplomatic conference on “disclosure requirements” in 2024. This decision signifies a significant step toward the adoption of disclosure requirement regime as an international standard. Under this circumstance, it is essential that the outcome is a legally precise instrument that is workable for patent offices and users. It is crucial that patent offices can implement the instrument without incurring additional or unreasonable operational costs. Furthermore, it is crucial that innovators (particularly SMEs) can navigate national requirements without uncertainty or financial burden. For the purpose, ⓐthe provisions of the legal instrument have been drafted to function as part of the existing patent system; ⓑThe disclosure requirement must be clear and reasonable to allow patent offices to implement the system easily and without undue burden, and to ensure that applicants are able to meet its requirements; ⓒSanctions must be balanced and take account of the underlying objectives of the instrument to ensure that the system is used appropriately while avoiding chilling effects on innovation; ⓓThis disclosure requirement is required to enhance the efficacy, transparency, and quality of the patent system, and to bring consistency and predictability to disclosure requirements across jurisdictions.
