DNA데이터베이스의 중요성은 최근 발생하고 있는 범죄들의 해결로 인해 입증되고 있다. 특히 살인이나 청소년 대상 성폭력범죄 등 재범의 우려가 높은 범죄를 저지른 사람의 DNA신원확인정보를 DB로 보관하여, 비슷한 범죄가 새로이 발생하였을 때 현장에 남아있는 증거물로부터 획득한 DNA정보를 DB내의 정보와 비교함으로써 범죄와의 관련성이 높은 사람을 알아내고 조기에 검거하는데 큰 역할을 하고 있다. 이처럼 DNA데이터베이스제도의 시행으로 인해 수사기관에서 쉽게 범인을 특정하여 범인의 검거율을 높이고, 대상자들은 재범을 할 경우 반드시 검거된다는 것을 인식함으로써 재범을 방지할 수 있는 효과가 있을 것이다. 현재 법률의 시행초기로 신체의 자유가 침해되는 문제와, 정보의 자기결정권이 위협받는 등 사회적으로 여러 논란과 비판이 제기되고 있다. 하지만 앞으로 제도에 대한 문제점을 명확히 인식하여, 더 이상 확대되지 않도록 노력하여 제도에 대한 우려를 최소화하는 방안을 모색해야겠다.
Abstract
The importance of DNA database is proven due to resolution of latest crimes. In particular, DNA database is useful to save a database on DNA identity information of ex-convicts who are likely to commit second offense such as murder or sexual assault (especially on teenagers), and compare information in DB with DNA information obtained from residual evidences on sites when a new and similar crime occurred. This way, DNA database plays a major role in detecting and early arresting any person who is very involved with crimes. Therefore, it is expected that the implementation of DNA database system will be effective in helping investigatory institutions to easily identify criminals for higher rate of arrest and will be also effective in ensuring that targeted convicts can recognize that they must be arrested when they commit any second crime, ultimately ending up with preventing second crimes. Now, there are a variety of social controversies and criticisms - e.g. issues about potential violation of physical freedom and potential threat of right to self-determination about information - posed concerning DNA database system which remains unfledged due to its early legal implementation. However, it is required to obviously recognize existing issues about the DNA database system and make more efforts to prevent any further expansion of such issues, so that we can explore possible ways to minimize concerns about said system.
