국내에서 자치경찰제도 도입에 관한 논의는 지속적으로 이루어졌으며, 엄격한 지방분권에 기초한 미국의 자치경찰제도는 도입 가능한 국외제도 중의 하나로서 종종 검토되어왔다. 하지만, 기존의 검토는 미국 자치경찰제도의 개요 및 현황에 대해서만 다소 피상적인 관점에서 접근하였다는 한계점이 있다. 이에, 본 연구는 자치경찰제도의 근간을 이루는 미국의 지방자치제도 일반에 대해 분석하고, 이를 바탕으로 캘리포니아주의 자치정부별 경찰조직의 실제 운용 사례를 검토하였다. 특히, 각 자치경찰의 근거법령, 조직, 사무, 예산 등의 사항을 검토하여, 자치경찰 운영의 독립성 및 자치성을 확인하였다. 하지만, 이러한 자치경찰의 독자적인 경찰권 행사는 제한이 없는 것이 아니라, 연방과 주정부의 입법·사법·예산 등을 통한 직·간접적인 통제의 대상이 되어, 각 자치경찰은 헌법의 기본원칙을 준수하고 관할 간의 통일된 법집행을 도모하고 있다. 그뿐만 아니라, 엄격한 독자성 및 분권성에 의해 초래되는 업무의 중복, 비효율성, 책임성 분산 문제를 해결하기 위해, 미국의 경찰조직은 각 정부 차원에서 다양한 협력 제도를 마련하여 시행하고 있다. 이러한 장치들은 한국의 자치경찰 시행에 있어 발생 가능한 시행착오를 일부라도 감소시킬 수 있는 시사점을 제공할 수 있을 것이다.
Abstract
For the past few decades, there have been numerous studies on the topic of the introduction of the local/municipal police system in South Korea. Some studies have proposed the municipal police system in the U.S., based on a strict decentralization, as one of the alternative models for South Korea. However, the previous studies have limitations in that they superficially reviewed the overall features of the U.S. municipal police system without deeply scrutinizing the system. Thus, this study aimed to analyze the U.S local government system, on which the municipal police system is predicated, and then review the actual operation of municipal police while focusing on the police agencies in the state of California. In particular, reviewing the statute, organization, duties, and budget of each county and municipal police agency, this study identified the strong independence and autonomy of each agency separating from federal or state police. However, the independence in the exercise of police power in each municipal police is not unlimited, but subject to direct and indirect control through legislative, judicial, and budgetary provisions of the federal and state governments. Furthermore, to solve the problem of redundancy, inefficiency, and distribution of responsibility caused by strict independence and decentralization, the U.S. police agencies have established and implemented various cooperation system at each government level. These systems could provide implications that can partially reduce the trial and error that may occur in the implementation of Korean municipal police in the near future.
