동물 성학대 범죄의 현황 및 근절을 위한 비교법적 고찰

오늘날의 반려동물은 단순한 애완용 동물의 수준을 넘어 하나의 가족 구성원으로 여겨진다. 이런 경향에 법과 제도도 변하기 시작해서 지난 10여 년간 동물보호법은 여러 차례 개정되었다. 그러나 여전히 여러 한계점이 남아 있는데, 특히 동물 성 학대 행위를 동물 학대의 유형으로 규정하는 동물보호법 개정은 이루어진 바가 없다. 이에 본 연구에서는 동물 학대의 유형 중 성학대에 초점을 맞춰서 진행했는데, 가장 근본적인 이유는 이러한 범죄가 동물에 대한 행위로 그치지 않고 더욱 잔인한 형태로 사람을 대상으로 진화한다는 것에 있다. 물론 모든 동물 학대 범죄가 공통적인 문제점을 안고 있음이 연구결과로 밝혀 졌으나, 성학대에 대해서는 연구결과도 없을 뿐만 아니라, 변태적인 성욕을 해소하기 위한 목적이 분명하고 가학적인 방식이 범죄자 자신보다 약한 사람을 상대로 투영될 가능성이 매우 높으므로 연구할만한 가치가 충분하다고 생각한다. 따라서 본 연구에서는 체계적인 연구의 진행을 위해 먼저, 동물 성학대 범죄의 개념 및 특징 등에 대해서 전반적으로 개관해본다. 그리고 현행 근거 법령의 주요 내용과 국회에 계류 중인 개정안의 입법목적·취지 등에 대해서 살펴보고, 국내의 주요 판례에 대해서 검토해보고자 한다. 이러한 내용을 바탕으로 독일, 미국 등 해외의 입법례와의 비교법적 고찰을 시도하여 우리 법제의 논의의 방향을 설정해보고 시사점을 찾아본다. 끝으로 본 연구의 핵심적인 사항으로서 다양한 형태의 법·제도적 개선안을 제안하면서 결론을 짓고자 한다.
Abstract
Today's pets are considered family members. In response to this trend, laws and systems have begun to change, and the Animal Protection Act has been revised several times over the past 10 years. However, several limitations still remain. In particular, no revision has been made to define animal sexual abuse as a type of animal abuse. Accordingly, this study focused on animal sexual abuse, taking into account that these crimes do not stop with acts against animals but evolve into more cruel forms targeting people. Of course, research results have shown that all animal abuse crimes have common problems, but not only are there no research results on sexual abuse, but the purpose is clear and the sadistic methods are very likely to be carried out against people weaker than the criminal himself. I think it's well worth doing. Therefore, in this study, in order to proceed with systematic research, we first provide a general overview of the concept and characteristics of animal sexual abuse crimes. And we also look at the main contents of the current laws and the legislative purpose of the amendments pending in the National Assembly. In addition, we review major domestic precedents and set the direction of discussion on our legal system by comparing them with overseas legislative precedents such as Germany and the United States. Lastly, as a key issue of this study, I would like to conclude by suggesting various types of legal and institutional improvements.
