공직자의 이해충돌방지제도의 입법화과정에 대한 연구 :2005년 백지신탁제도 도입을 중심으로

초록

공직자의 윤리를 확보하기 위한 많은 노력들이 이루어지고 있다. 공직윤리의 확보를 어렵게 하는 대표적인 원인으로서 이해충돌(conflict of interest)의 문제를 들고 있는데, 이를 방지하기 위한 효과적인 방법으로서 미국이나 캐나다 등에서는 오래전부터‘백지신탁제도’를 활용하고 있다. 백지신탁제도는 공직자가 보유하고 있는 사적인 재산과 공직자로서 수행해야 할 공적 직무간에 이해충돌이 발생할 경우, 이를 해소하기 위한 제도적 장치이다. 우리나라의 경우도 지난 2005년 공직자윤리법을 개정하여 동제도를 도입하여 활용하고 있다. 그런데 공직자의 이해충돌에 대한 문제 제기 및 이것의 해결을 위한 방안으로서 백지신탁제도의 도입에 대한 논의가 1990년대 후반부터 이루어졌으며, 최종 입법화까지 약 8년 정도가 소요되었다. 이 제도는 우리나라 공직자의 윤리를 확보하기 위한 상징적 제도의 하나로서, 지난 8년 동안의 논의과정을 분석하는 것은 매우 의미있다. 특히 이 논의과정에서 시민단체를 비롯한 많은 주체들이 참여하였으며, 이 과정에서 동제도를 둘러싼 다양한 논의들이 이루어졌다. 본 연구에는 각종 자료를 수집, 정리, 분석하여 백지신탁제도가 도입된 과정을 체계적으로 분석하였다.

Abstract

Conflict of interest is the most significant factor weakening public servant's ethics. In many developed countries like as USA or Canada, blind trust has been used to prevent the conflict of interest. Blind trust is the useful institution to dissolve the ethical dilemma between private asset and public obligation as a public servant. Korea had updated Public servant' ethics law to introduce the blind trust system in 2005. In the late 1990s, some NGOs had appealed many conflict of interest case in government and national assembly and suggested the introducton of blind trust. About 8 years were taken to introduce the blind trust in Korea. Blind trust is the symbol of ethical system in public sector and the law initiated by NGO. So the analysis of legislative process of conflict of interest prevention system in Korea is very meaningful research for the systemic introduction of similar law or institution.
