Abstract

Since the late 20th century, an atmosphere of reconciliation and cooperation began to develop between South and North Korea, culminating in the adoption of the “Agreement on Reconciliation, Non-Aggression and Exchanges and Cooperation between the South and North Korea”, commonly referred to as the Inter-Korean Basic Agreement, on December 13, 1991. Chapter 3 of the supplementary protocol signed the following year explicitly stipulated measures to protect rights related to each other’s works. This reflects a mutual recognition of the need to address issues such as the unauthorized use of copyrighted materials. Following the lifting of the ban on works by North Korean defectors, several lawsuits have been filed in South Korean courts concerning the unlawful use of North Korean works. These cases have raised various legal and constitutional issues, including the verification of original authorship, procedural matters such as proof of legal representation, and the legal status of North Korea and its citizens. Currently, both South and North Korea affirm copyright protection in their respective constitutions and legal systems, and are parties to relevant international multilateral treaties. However, due to fundamentally different approaches to copyright stemming from their distinct political systems, there exists a significant asymmetry in the scope and degree of protection. According to the theory of the special inter-Korean relationship, North Korea is regarded as an equal partner in reconciliation and cooperation, implying that the principle of reciprocity based on mutual recognition is indispensable. This also means that North Korea must implement copyright protection measures equivalent to those in South Korea. In this context, to resolve disputes over copyrighted works and to ensure sustainable exchanges, further agreements between the two Koreas and active efforts toward their implementation are necessary, including judicial cooperation and institutional reforms.
