Abstract
When a North Korean defector group incorporated as a legal entity disseminated leaflets into North Korea, the government revoked the group's corporate establishment permission pursuant to Article 38 of the Civil Act, citing several grounds, including that it had engaged in activities beyond its stated purpose and had harmed the public interest. The defector group subsequently challenged this decision in court, seeking the cancellation of the revocation. The first-instance court dismissed the plaintiff’s claim. It reasoned that the government’s measure constituted regulation of the method, rather than the content, of expression, and concluded that it did not infringe upon freedom of expression. It also upheld all the grounds cited by the government. On appeal, the second-instance court also affirmed the government's decision but applied a stricter scrutiny. It upheld only part of the government’s reasoning-that the plaintiff's actions harmed the public interest-and provided a more detailed analysis regarding restrictions on freedom of expression. In the final instance, however, the Supreme Court (Decision 2023Du30833) provided a detailed interpretation of the criteria and meaning of “acts detrimental to the public interest” stipulated in Article 38 of the Civil Act, ultimately reversing the appellate court’s decision. It held that the plaintiff’s act of disseminating leaflets did not constitute an act detrimental to the public interest and characterized the government’s measure as a content-based restriction on expression. This ruling is justified and significant in reaffirming the importance of robust protection of constitutional rights, including freedom of expression, particularly in interpreting provisions of the Civil Act. It is also worth noting that Supreme Court Decision 2015Da247394-which held that the police or other authorities may, under certain circumstances, lawfully restrict private actors from distributing leaflets toward North Korea-may be viewed as acceptable. Although this decision may appear to conflict with Supreme Court Decision 2023Du30833, the two decisions are not, in fact, inconsistent, apart from certain inappropriate expressions contained in the former ruling.
