경찰의 산업스파이 대응 정책 연구

Abstract

Industrial espionage threats are ever increasing. Threats posed by foreign intelligence entities and insiders will continue to evolve in terms of scope and complexity. The capabilities and activities through which seek to access to the secrets of industrial or economic information are very diverse and technically sophisticated. The methods of operation are diverse and evolving according to the actor’s ability to use advanced technologies. Types of espionage operations are academic solicitation, attempted acquisition of technology, conferences and trade shows, criminal activities, official foreign visits and targeting, requests for information, seeking employment, solicitation or marketing, suspicious network activity, targeting travelors overseas, etc. Foreign entities or insiders will continue to employ human and cyber means to collect national security information and economic secret information in Korea. Police should be prepared for these kinds of espionage operations committed by foreign entities and industry insiders within the limits of legal foundation in Korea. However, Korean National Police has started to investigate industrial espionage cases recently, since 1996, after the establishment of the trade secret protection law. KNPA needs to enhance the capacity of counterintelligence and remedy shortfalls of KNPA industrial espionage investigation. Obama, America’s president, issued ‘Administration Strategy on Mitigating the Theft of U.S. Trade Secrets’ in 2013, which includes many practical policies in the domestic and foreign areas. This strategy is the product of a collaborative effort and reflects the recommendations and input from various government Information Community members. Strategic action items are 1) focus diplomatic efforts to protect trade secrets overseas, 2) promote voluntary best practices by private industry to protect trade secrets, 3) enhance domestic law enforcement operations, 4) improve domestic legislation, 5) public awareness and stakeholder outreach. Based on these America’s 5 Strategies of the President Obama, this thesis proposed several counter-trade secret espionage police policy. This Thesis recommended 7 policy proposals, 1) Join the Interpol’s transnational investigations, 2) train the trade secret espionage investigators, 3) build networks among law enforcement institutions, 4) make a ‘strategic partnership program’ for preventing trade secret espionage, 5) enhance public awareness by making educational video and etc, 6) perform continuously specialized investigations in specialized local area and support those activities, 7) dispatch cyber investigators abroad and cooperate with other countries.
