영국의 수사·정보기관의 사이버안보 공조체계와 시사점

문재인 정부 들어와서 국정원의 대공수사권을 경찰로 이관하는 문제가 논의되고있는 가운데, 대부분의 국가차원의 범죄나 테러가 사이버공간에서 발생하고 있고 대부분의 범행 모의 시작점은 사이버상에서의 교신 등으로 이루어지기에 정보 수사기관간의 공조는 아주 중요하다. 비록 정부 조직차원에서는 영국의 사이버안보를 맡고있는 GCHQ (Government Communications Headquarter)가 한국의 정보기관과는 조금 다른 역할을 하고 있기에 대등한 비교는 어렵겠지만 영국에서의 GCHQ가 사이버안보와 관련된 현안에 대해서 MI5 (국내정보를 담당하는 보안부)·MI6 (국외정보를담당하는 비밀정보부), 군 정보기관과는 어떻게 차별화된 업무를 하는지? GCHQ와NCA 산하의 NCCU (National Cyber Crime Unit: 국가사이버범죄수사과)와 ROCU (Regional Organised Crime Units: 지방단위 조직범죄수사단)은 사이버안보 최전방에서 어떻게 활동하고 있는지? 살펴보고자 한다. GCHQ산하의 NCSC (National Cyber Securiy Centre: 국가사이버안전센터)는 국가수사기관들과 사이버안보를 위협하는 범죄에 공조하기 위해 6가지 카테고리를 만들어서 운영하고 있다. 최상위 카테고리1은 “국가사이버위기사태 (National Cyber Emergency)” 상태로 국가안보에 중대한 위협을 끼치고 사회적 경제적 불안과 생명까지도 잃게 되는 상황을 말한다. 이 상태가 되면 내각의 전략적인 리더쉽 아래 NCSC (National Cyber Security Centre: 국가사이버안전센터)가 전술적으로 법집행기관들과협조하여 대응한다. 그밖에 공조를 지원하는 UK NIS Directive 등 관련 법률과 규정들에 대해서 알아보고 이 지침이 어떻게 영국 법률 구현되는지? 알아보고자 한다. 그리고 NCSC (National Cyber Security Centre: 국가사이버안전센터)·관할 당국(CAs)및 필수 서비스 운영자(OES) 간의 관계를 자세히 설명하고 있다. 마지막으로GCHQ가 운영하는 “미래 사이버안보 전문가(Cyber First)” 양성 프로그램과 같이 유용한 프로그램에 대해서 향후 우리나라에 도입을 고려해 보고자 한다.
Abstract
Mutual Assistance among law enforcement agencies is well known practice in the criminal justice system while mutual assistance between intelligence agency and law enforcement agency. In order to respond to the national cyber security breach, it is essential to collaborate between two agencies. Mutual Assistance between GCHQ (Government Communications Headquarter)/NCSC (National Cyber Security Centre) and NCA (National Crime Agency)/NCCU (National Cyber Crime Unit) in the United Kingdom appears the most applicable practice for korean intelligence and law enforcement agencies. This study introduces how the UK intelligence and law enforcement agencies re-organized the sub-affiliated agencies for the effective and efficient collaboration to respond to the national cyber security breach. NCSC created 6 different categories to respond to the cyber threat with the law enforcement agencies. For example, category1 requires the collaboration between intelligence and law-enforcement agencies to respond to the national cyber security threat under the supervision of the prime minister office. In addition, how UK NIS Directives defines the role of each entity and supports the UK law for the mutual assistance. among intelligence and law enforcement agencies and government agencies and private sectors. Finally, National Cyber Security Strategy 2016-2021 introduces the importance of the integration of cyber security technology and high quality cyber security training and education. Finally, GCHQ operated “Cyber First” program shows how this program forsters the future leader of cyber security.
