외국의 불법주정차 단속법규와 그 운영의 시사점- 미국과 일본을 중심으로 -

이 연구는 미국, 일본 불법주정차 법집행모델을 비교분석하고 한국불법주정차 관련 법집행제도의 발전적 방안을 제시하는 것이 목적이다. 본 연구는 문헌분석에 기초하며 미국과 일본 그리고 한국의 불법주정차 관련 법규, 집행과정, 과태료, 조직 등에 대한 비교분석을 진행하였다. 불법주정차 관련 법률의 경우 한국은 “도로교통법”과 “주차장관리법”, “질서위반행위규제법” 그리고 “자치단체들의 자치법규”에 근거하여 운영되고 있으며, 미국 뉴욕주의 경우 “연방교통법규”와 “지방의 차량과 교통법”, 일본은 “도로교통법”과 “주차장법”, “보관장소법”, “도시계획법”, “건축기준법” 등에 근거하여 불법주정차를 단속하고 있었다. 이 논문의 연구결과는 불법주정차로 인해 가장 많이 발생하는 보행자사망사고를 억제하기 위해 첫째, 미국과 일본처럼 단속기준 시간인 5분에 상관없이 불법주정차 현장에서 법집행할 수 있어야 한다. 둘째, 자동차운전자가 차량에 탑승한 채라 할지라도 법집행을 할 수 있도록 해당 법률에 대한 개정이 이루어져야 한다. 셋째, 법집행과정에서 통일된 집행을 위해 지자체장(구청장 및 군수)으로부터 불법주정차관련 법집행업무의 독립성이 보장될 수 있도록 하여야 한다. 무엇보다도, 한국의 경우 불법주정차 법집행제도와 관련한 가장 시급한 문제는 불법주정차로 인해 가장 많이 발생하는 보행자관련 사망사고를 획기적으로 억제하기 위해 2018년 현재 관행적으로 이어오던 단속기준 시간인 5분에 상관없이 불법주정차가 발생하면 해당 현장에서 법집행할 수 있어야 한다. 그리고 자동차운전자가 차량에 탑승 한 채라 할지라도 불법주정차 관련 법집행을 할 수 있도록 해당 법률에 대한 개정을 통해 지역사회에서 시민들의 교통안전을 확보할 수 있도록 노력하여야 한다. 그리고 법집행과정에서 통일된 집행이 이루어지도록 지자체장(구청장 및 군수)으로부터 불법주정차관련 법집행업무의 독립성이 보장될 때 지역사회에서의 원활한 교통안전 확보 및 궁극적으로 지역사회구성원들의 삶의 질이 향상될수 있을 것이다.
Abstract
The purpose of the present study is to compare and analyze American and Japanese law enforcement system against illegal parking and to provide implications to Korean law enforcement system against illegal parking. Based on previous research studies, we compared American, Japanese, and Korean illegal parking related regulations, enforcement processes, penalty, and organizations. To control a number of pedestrian deaths, first, crackdown on illegal parking should be enforced on site like the United States and Japan. Second, related law should be amended in order to regulate illegal parking drivers although they are sitting in the car. Third, head of local government should be able to enforce illegal parking law independently. Additionally, in order to control and prevent pedestrian deaths by illegal parking on the street and road, law enforcement force such as criminal justice agencies such as police and other agencies have to deal with enforcement to them strongly in the street. Through improvements of laws such as Transportation and Road Safety Act, drives who is in the car can enforce to reduce car accidents in the community. It can be argues that the issues of illegal parking in South Korea can be controled by improvements of laws regarding road safety, proactive enforcements of public officers and changed mind of community individuals relating traffic safety.
