사학의 자율성 등에 관한 비교교육적 연구-사학 공영화 정책 비판을 위한 미국 사례 분석을 중심으로-

최근 교육계에 정부가 추진하는 사학의 공공성 강화 정책이 이슈가 되고 있다. 사립학교들은 재정이 취약하고 공적 관리의 허술로 인하여 많은 문제가 발생하고 있으며, 학교의 공공성이 보장되지 못하고 학생의 학습권이 침해되고 있다는 것이 이 정책의 전제이다. 정부가 추진하는 공공성 확보 방안은 세 가지이다. 사립중등학교를 공립화하거나 또는 준공립화하고 사립유치원이나 사립대학을 공영화하는 것이다. 구체적인 방법 간에 차이가 있겠지만 공통적인 것은 큰 틀에서 사학을 공영화하겠다는 것이 다. 사학의 공영화 정책은 심각한 문제를 내포하고 있다. 사학의 문제를 전체적으로 균형 있게 보기보 다 한쪽으로 치우쳐 있고, 그 추진 강도가 일부 문제 사학만을 겨냥한 것이 아니라 사학 전체를 공영 화의 틀 속에 가두려고 한다. 이 방안은 결과적으로 교육의 획일화라고 하는 전혀 다른 차원의 교육의 본질 문제를 야기한다. 교육의 획일화는 교육의 본질로서의 다양성을 부정하는 것으로 전체주의 사회 에서나 통용될 수 있는 발상이다. 우리 헌법이 지향하는 자유민주적 기본질서와 문화국가 원리를 부정 하는 것이다. 본 연구는 비교연구로 가장 선진적인 교육시스템을 가진 미국 사학정책의 사례들을 검토 한 것이다. 미국에서의 사학의 비중 및 현황, 사학의 자율성 보장, 사학에 대한 재정지원 방식으로서의 바우처제도와 사학의 학교선택권 보장, 공립학교의 차터스쿨화 동향을 살펴보았다. 연구 결과 받은 시 사점은 여러 가지가 있지만 기회균등의 진정한 의미에 관한 것에 주목하게 된다. 공영화정책으로 잘 하고 있는 사학들을 없앨 것이 아니라 오히려 장려하고 형편이 어려운 학생들에게 바우처를 제공하여 이 학교들을 선택할 기회를 주어야 한다.
Abstract
Recently, the government's policy to strengthen the public nature of private schools has become an issue in educational societies. It is said that private schools are experiencing many problems because of their weak finances and poor public management. They say that the public nature of the school is not guaranteed and students' right to study is being violated. There are some ways for the government to secure public nature of private schools : to convert private secondary schools to public schools, to put methods of public management into private kindergartens or private universities. There is a difference between specific methods. What is common, however, is to strengthen public nature of private schools. The policy poses a serious problem. It wants to keep all the private schools under the framework of public management. This policy causes the problem of the nature of education on a completely different level, called uniformity of education. The uniformization of education denies diversity as the essence of education. This idea can be accepted in a totalitarian society. It denies the basic order of liberal democracy and the principle of cultural state that our Constitution is aiming for. This study examines cases of American private school policy with the most advanced education system as comparative study. This paper studies autonomy of private schools in the United States and the voucher system for students' rights of public schools to choose private schools, and charterschools for privatization of public schools. There are many points of view related to true meaning of equal opportunity. The public management policy should not eliminate the well-performing private schools.
